K1 first then B2 for mother? or it doesnt really matter?

Hi VJ

we are going to apply tourist visa for my mom pretty soon. we want her to come to my wedding on May. my K1 application is still in RFE and we are waiting for the RFE notification on our mail.

Q1: do you think we should wait until i get my NOA2? or until K1 visa in hand.. or it will be just fine apply for my mom now.

i want to know the pro and the cons because the decision will give us time to catch flights for her and I.. airfare flies so high!

Q2: what do you think about this case?

My mom has no birth certificate she just have some kind of reference letter from midwife to the local government (surat lahir). and the letter is on awful handwriting and almost ripped off ( i mean really ripped off ). do you think this is will be the problem? she used that letter when she applied job, school and passport.

this is her condition:

-she has a small house on her name and a house with her former husband name on it (he died already)

-she is currently working as a elementary school (we have her letter of employee and letter for days off from the school)

-she has no fat bank account definitely wont be able to pay round ticket so my fiance write a letter to explain the intention to take care all the expenses of hers

Q3: do you think she will have chance to get B2 visa for my wedding?

To be clear you arent going to apply for a visa for her. She will do so. The most important aspect is conforming to the " strongest ties " rule. She has to demonstrate why she MUST return to her country. All people with visas are considered intending immigrants. She must overcome that concept.

She will have to give a reason she wants to come to the USA. That reason will be to visit her family & attend a wedding. There is a long history of fraudulent use of tourist visas to gain entry into the USA by people from many Asian countries including my own. This has great bearing on the ability of others to get these visas.

The only way she will ever know is to apply & be interviewed. Try to find people that have done so from your country to use as an example.

For starters I think you will be pushing it to have a wedding in May when you have only just had an RFE and have not heard back from USCIS yet. AS stated before you don't apply for a tourist B2 visa she does in her country. She has to show strong ties to her home and that she will return . She has a home and a job all good but I would wait till you get your visa first as you may be disappointed with plannng for May.

what you need to do is talk to a lawyer about her birth certificate issue.Indonesia has unique circumstances as far as the birth certificate and name goes.plus since you want her there for an specific date,i suggest at LEAST consulting with a very good lawyer.i have seen people go through for a tourist visa at least here in iran with as much evidence as you mentioned:a job,a retirement fund ,a house and or a car.if you look at the forums required for a B-2 or the guides even on DOS website,they mention that if the person applying for a tourist visa can not support him/herself he/she will need someone who is capable of supporting them and can prove so.HOWEVER you want your mom there for your wedding so,technically your fiance is a complete stranger legally speaking at this point.i have no idea how that works but one supporting someone else is an option

If it is very important for your Mother to be t your wedding, the K1 is not the correct option.

She can certainly apply, sounds like a long shot.
