Joseph and I were talking about family based petitions after talking to the woman at the salon who came over on these. He asked me that in a sibling petition , if the sibling is older and doesn't want to stay in the US but wants their children to come. How long would the sibling have to stay for the children to benefit ? Would they have to stay until the children were over 18 ? Could they all come and leave the kids with the uncle then leave ? Would they have to get USC or could the children eventually be USC's on their own ? I have never heard of anyone doing this but I figure someone on here might know the details. The woman that does my nail said her aunt came because she wanted her children to have a good education and Joseph was asking how long the aunt has to stay.

They can come and leave .. the Primary beneficiary does not own the AOS.. the petition is still responsible. IF the parent goes OUT of status that does not affect the child's status. They can gain citizenship-status on their own.
