How to disclose traffic violations on N-400

Hi,

I got 3 traffic tickets 7-8 years ago for unsafe driving and fail to stop at stop sign. I took defensive driving and deferred adjudication, so all 3 tickets were disposed/ dismissed. I looked up online and it said "Case status: DISPOSED, Disposition: DISPOSED DEFERRED DISPOSITION"

How to write this on N-400? What to write on section about "Why were you arrested, cited, detained, or charged" Do I need to write unsafe speed, fail to stop at stop sign, or just write traffic moving violation?

Also, what to write on section about "Outcome or disposition of the arrest, citation, detention, or charge" Since the status of my case "Case status: DISPOSED,

Disposition: DISPOSED DEFERRED DISPOSITION", do I need to write Charge dismissed/disposed, charge dismissed, DISPOSED DEFERRED DISPOSITION, or what to write?

Does anybody have any experience on this?

Seems to be the latest bug with several cases posted recently, we fall in that class as well. Proof of whether you paid your fines or not is the key issue. Would not submit that with your application but definitely bring in proof to your interview. Or you will be in for a delay. Is a statue of limitation with your insurance company, three years, but not with the USCIS.

Was really frustrated when that idiot kid hit me back in 95, was determined in a court of law, that kid should have never been issued a drivers' license, so asked my attorney if I could sue the DMV. No I can't, they are not liable, matter of fact, they are not liable for anything, but insurance companies sure are, so why do we even have a DMV? When its your insurance company that decides whether you are a safe driver or not!

Daughter-in-law just got her first speeding ticket. If you drive on a Wisconsin or any state road, have these damned little towns a half a block wide and ten miles long, after you leave that town and in the bare sticks, can be another half to a full mile before the speed limit gets back to that slow 55 mph, use to be 65 mph. She saw the sign up ahead and started speeding up and was trapped. Cop told her is she contested the ticket would hit her for 30 mph over the limit, but if she didn't, would write it for ten. That is blackmail!

Other traps our exiting a freeway, don't touch your cruise control button, but do brake when going down a steep hill. Since 9/11 they have doubled the size of all our police departments for security reason, our town had to hire a magistrate to handle all these new fines. If a bar is on a county road, instead of 55 is now 35 a half a mile before and after that bar. All yield signs in our town were replaced with stop signs. For better to park your car at those than to creep. 15 mph limits were limited to schools only, but now for industry, nursing homes, hospitals, churches or anywhere they may be some traffic. Would think for a church, maybe just on a Sunday morning, but no, at all times, not even when people are present.

Further complications are with our society where everybody has to be at the same place at that same time. Built a new school in town on the far east side, I live on the far west side on a two lane road with over a thousand kids being dropped off, what a mess. Then a parent has got to be on work at time, really feel for parent that have to drop off kids at daycare centers, elementary, mid, and high schools scattered all over town and can get canned if late.

Surprised there isn't a major rebellion on this issue, but to make it even worse, the USCIS joined the band wagon for what you may called double jeopardy.

I'm not gonna submit the disposition results of the traffic tickets with my N-400 (the USCIS instruction say that I don't need too), but I want to disclose that I received traffic tickets in the past. Question #16 on part 10 clearly stated "Have you been arrested, CITED, or detained by ANY law enforcement officer (including USCIS or former INS and military officers) FOR ANY REASON? The question does not say that if you just receive traffic tickets, you don't have to disclose it. As far as I understand it, I need to disclose any citation that I receive by any law enforcement officer for any reason and that's including citation for traffic tickets.

Delay on N-400 case is not a problem to me. I just don't want USCIS to think that I lie on them by not disclosing citation of traffic tickets and then possibly deny my N-400 case. That's what I'm worried about.

it's always good to mention this things. i did as alot of people here in Vj's did. By getting a ticket for not stopping a stop sign it will effect u getting ur Citizenship.

Just be prepare, and go to the DMV. and get ur Driver Record . it cost $5. and have all ur Tickets ready just in case.

My interpretation of it... not to disclose if it was under $500. So I did not disclose my tickets. IO asked me, I said it was under $500, he asked if it was just speeding ticket and I said yes, and he moved on.

SO clear.

When it says Have you ever been cited. That tells alot. Yes write it better for you, it will do no harm for u at all. Yes.. under $500 dont have to submit any documantations. but it never said on the Instruction not to mention it.

I have a similar problem, I once was pulled over by a military police officer for speeding on base. I only got a warning which I had to give to my husband and he and gave it to his commander. Nothing ever happened after that, it was only a warning.

So, on the application, would I just write "1. speeding citation 2. when 3. where 4. warning- no charges filed" ??

I don't even have that ticket anymore...

Here we go again with your IO making a big deal out of this, could carry this to the nth degree, when my wife had had biometrics in Milwaukee, we were stopped and detained by an officer for 45 minutes, because there was a major accident ahead. Should we have reported that? Stepdaughter was stopped because of a burnt out tail lamp, has four on the back of her car, was given a warning, I replaced the bulb and signed off the warning and mailed it back, positivity no record of that. If anyone has a complete record of your driving record, its your insurance agent. I contacted mine and he sent me a complete record of everything on her record. We couldn't use that, wasn't certified, but gave a basis of where to look and to remember.

But on her letter, said not to send anything about traffic violations, she was accused of three things, battery at the age of 17 months, assault at the age of four, and having her drivers' license suspended. But the whole thing ended up being a mistake, senators office squared that away and she did get her oath letter. Have no idea how she behaved during her interview, but you have to be super nice, sit straight and dress well. She came home wearing fashion blue jeans, thank goodness was the same size as her mom.

Warnings are not recorded, especially on a military base, wouldn't worry about that. But can check with your insurance agent to get a complete record of your driving history. They really keep track of that.

SAND, you obviously did NOT read the N400 instructions. A lot of you people seem to think you know it all. The IO went through my application, he even asked me my name, address, phone number, etc... So the IO asking about traffic violation was not a big deal but just going over my application. I am glad I did not rely on you for filling out my application... I am now a US CITIZEN...

The Christian Church interpreted the red hair of woman as a clear sign of witchcraft and consequently burned them on the stake. You were clearly required to disclose this and swore that you would be telling the truth at the interview, so God help you. Not doing so is purgery under oath which is a felony which is a reason to revoke the citizenship.

You got lucky that the I.O. asked you specifically about this and you then disclosed it as required. It's much better, however, and much safer, to disclose it upfront on the N-400 form. Any violation needs to be disclosed in question 16, but not documented.

Since you have problems with that term understand what it really means: you disclose the violation by listing it, but if the fine was under $500 you are not required to bring paperwork about it with you to the interview.

That said, we have had just recently a case here on VJ, where the N-400 process was put on hold after the interview until the applicant submitted a court statement regarding traffic cases. The "no need to document" is but a guideline. An I.O. can ask whatever he or she wants, and the foremost thing they ask for is honesty as this goes straight toward the "good moral character" requirement.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans.
