Hello All.! I have been using VJ since day one and it has been very helpful. Here is my situation: I met my girlfriend when I was working as a expat oversea's about four years ago. When the economy started to deteriorate in 2008 we started making contingency plans and started appling to Universities in Europe. We both got accepted and moved to Europe in 2009 and finished our masters degree in 2010. We decided to take a vacation to the USA in the summer of 2010 and right before her 6 month tourist visa was over I decided to ask her to marry me. We went and got married before her visa (I-94) expired. We then started the process of apply for her green card (I-485), and my support documents (I-864).

I currently don't have a job, because I just graduated last year. The Income from my 2009 Tax Return shows 0 (Zero).

I went ahead and used form I-864EZ, and got a letter back 1 month from the date of submission, this is what it stated:

'The petitioner/sponsor on form I-130 has submitted form I-864EZ, Affidavit of Support. However, the petitioner/sponsor's income listed on the income tax return provided does not meet or exceed 125% of the poverty line. The petitioner/sponsor cannot submit form I-864EZ to satisfy the Affidavit of Support requirement....'

1. Does the amount of my assets have to be three or five times above the proverty level of $18,387?

2. What, if any extra form, do I need to use to prove that I have assets, other than I-864?

From my understanding I need to have three times the amount above $18,387 (refer to the latest poverty guideline 2011). Which is $55,161. I have in my personsal bank account slightly above this amount. Is this enough?

1. It it three times the DIFFERENCE between your income and the requirement. So if you're short $10,000 you need $30,000 in assets.

2. No, just the I-864. You just need the evidence of it and to complete the "assets" page of the I-864.

Thank you for your quick response Vanessa&Tony.

Therefore, if my Income is zero, then I would need about $18,387 x 3 = $55,161 in assets, correct?

My other concern is that I took out Federal School Loans to pay for my studies, will the USCIS automatically subtract that from my assets?

Example: I am currently not employed. I have $25,000 in school loans due. I have $60,000 in cash/liquid in a personal bank account. I am using I-864 to apply for an Affidavit of Support. Will my total assets be $35,000 or $60,000? Will the USCIS even know that I owe on this loan?
