In a nutshell, I screwed up. We live in Florida and I did not count on the 3 day waitng period. I didn't know it didn't include weekends. So the marriage took place 91 days after her arrival. My AOS based on the K1 visa has now been denied.

I have been reading the threads and see that my best route is to refile using the I-130 and I-485 route. I just have a few questions on form 485 that maybe someone can help me with. One other issue that makes it difficult fo rme to know what to place in these boxes is that we also travelled on a I-131 parole document to Jamaica, so we have an additional date of her "last arrival" here.

Ok, the questions:

Part 1 Date of Last Arrival , as I stated we have her initial POE, but now we also have her last one from Jamaica. It seems I need to put Jamaica as her last entry, but I would think they are really looking for her initial POE. Just not sure.

Current USCIS Status I am not sure what her status is considered right now.

Part 2 Application Type The only thing that seems to fit here is Other. So I guess that will be the type and I will need to attach a paper explaining the AOS denial from K1?

Any other advice is appreciated.

Application Type is A - you are attaching a relative petition, which if approved, will make a immigrant visa number available (got to read between all the lists in that one).

Not sure on the other ones. Good luck.

You're now filing based on an I-130, not the K1. So:

1. Last entry yes, is from Jamaica.

2. It's an Application for permanent residence

You don't need to attach anything about what happened with the K1 because it's all in her file. You will need to send a copy of the K1 visa though, as what visa she entered on, and as I've never seen an AP after someone's left the country on one I can only go by what I've read, in that they stamp it... SO I would attach the K1 visa and ALSO the AP document showing that she entered legally again on that (hence the changed date from the Jamaica visit).

Thanks for the advice....What I do not understand is that it staes that I have to attach a copy of an approval notice. I am not sure if this option will qualify me?

Do you have any insight into this?

Read more carefully. It says in parentheses, "Attach a copy of the... relative petition... filed with this application that will give you an immediate available visa number, if approved."
