K-1 or CR-1?

Hi there,

I am US citizen, my fiancee is Chinese citizen. After we did some basic research in this wonderful web site, we find out that the average processing time for CR-1 is 9 months. But it takes much less time to process K-1 visa.

So we want to decide which way we should proceed; cost and all the hassles after she arrives in US through K-1 are not problems to us.

which way should we choose? How much chance will she get K-1 visa if this is the way we wanna go?

The choice is yours to save time or money. The K-1 route has more hassle and expenses but the time difference is not that much anymore. It's your call!

It's completely up to you.

The K1 is a "be together sooner" visa. The CR-1 is a "work and leave US on entry visa".

The K1 means you can file right now. The Cr-1 means you have to wait until you get together next and marry. CR-1 means being apart from your wife, not just your fiancee.

If the not working for months doesn't bother you (with the K1) and the effort of AOS (which honestly isn't that bad) then I would file the K1. It means you're together quicker.

I vote for 'CR-1 visa'.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I notice the time diff is only 2 months (correct?), so probably CR-1 is the way to go.

The PROCESSING difference might only be 2 months (could increase with RFE's or decrease if USCIS are on their game) but the time difference will increase depending on how long it takes for you guys to get together and marry.

The CR-1 IS superior in terms of the working and travelling immediately but I simply don't like the idea of getting married and then spending almost all of the first year of marriage apart. Travelling and working immediately on entry for my (then) fiance and I wasn't a huge enough deal for us to be okay with being apart from our husband/wife. If you and your fiancee are okay with that then sure, go the CR-1.

Mind you, you have to be married first and obtain a marriage certificate and other documents of proof before you file for the CR-1. You would include the evidence of your marriage with the I-130 petition for your CR-1.

The likelihood really is the same for K1 and CR1 - I don't think there's any reason the CR1 is more of a sure-thing than the K1 from everything I've read the last few months... For the K1 visa, at the USCIS stage, you only have to prove you've met in person the 2yrs before filing, and at the consular stage, "proof of a bona fide relationship" seems to be less of a concern than for the CR1 visa, in which case you have to provide more evidence that you're engaged in a real marriage relationship, which I personally think is more difficult when you're living apart...

I might be off base on this - if so, I'd be happily corrected!

June, 2010 - We got engaged, looking forward to a small August 2010 wedding

March 10, 2011 - Packet 3 delivered to Montreal

March 21, 2011 - Packet 4 sent to me

April 5, 2011 - Medical

April 13, 2011 - Interview - approved!

April 20, 2011 - visa in hand

May 9, 2011 - POE (Buffalo, NY)
