Yes I am pretty sure that you will need to have your 2010 tax return during the interview. I am in the same postion as you are and I sent in my 2009 tax return and we still do not have a interview date. I called and spoke to a NVC operated and asked her this question about a week ago and she said that the beneficiary will need to have the 2010 tax return at the embassy interview, because they check to see if the petitioner still has sufficiant funds to support the beneficiary. I mean even if the interviewer does not ask for them its better to be safe than sorry. I would just send the beneficiary the 2010 tax return and W2 just in case. Hope this helps. Good luck!!

Personally, I don't think it will be an issue if you have 2010, 2009 and 2008 along with the past 3 months pay stubs and letter from employer. they just want to see a history of you earning income and are above the poverty guidelines.

Although our interview is just prior to April 15th, we were planning and still are doing an extension of the taxes. It simplifies things so much since the SO will have an opportunity to enter the US and get a SSN to file with. I wouldn't extend past 1 request because after that , it would be quicker to file for an ITIN,ect. We're still doing an extension and my wife will have a copy of the request sent to the IRS for proof. I'll send prior to the interview, my last 3 months pay stubs and am mulling over requesting my company's HR to do a more current letter of employment to include also. I'm with Sqdnguns on this pt, they just want to see your currrent income streams to make sure nothing's changed drastically.

Malak805 has a good idea of sending a copy of the W-2 's and 1099's if the current years taxes aren't completed. As with any step in this journey, you can never have too sure of a step. Best of luck!!

maybe we should get a request for extension instead of filling in a hurry

my husband is self employed so he will get the employment statement ready like we sent for 2009 to NVC

I hope that would satisfy them together with the extension letter

They may not be required but you should be have a copy of the 2010 that is being filed because you could be denied if is requested at the interview and you cannot present evidence the evidence. You do not need the 2010 IRS tax transcript just a copy of what was filed, it is best to be prepared for anything that could cause a denial at interview.

If you file an extension, then you haven't filed your taxes yet thus you can't produce the return that wasn't filed. Your request for extension should be sufficient evidence of your intent to file but it would be prudent for the sponsor to forward proofs of recent income or at least last years income to the SO for additional proof of satisfactory level of income to alleviate the CO's worries. It is so close and falls within the time period allotted (Till August) that the consulate officer all most certainly will be good with the situation. I'm not a consulate officer nor an IRS agent so my advice and $2 will get you some coffee. I will say this is our route and if it doesn't work, then I'll be the first to post so on the 12th of April...... Best of luck with your decisions...!!:thumbs:

:thumbs: You are correct. As long as the beneficiary has recent pay stubs, previous year's W-2 and a copy of the extension then they will fine...you can't produce a copy of what you don't have.

When I submitted my financial data, (I am self-employed) I submitted 2009, 2008 and 2007 tax returns, and in addition my monthly bank deposit statements showing how much money I deposited in each of my accounts for the year 2010. I also had an officer of each bank write and sign a letter stating how much I deposited, as well as how much was currently in each account. This was in late January 2011 that this was done.

Now our interview date is April 7 in Nairobi, and I guess I can rush up and prepare my 2011 tax return, reflecting 2010, if that might be required.

Tax returns is one of the biggest pitfalls of the interview causing AP (221(g)) especially for self-employed sponsors.

Next time I'll walk into the embassy with a set of transcripts for the past 3 years, a set of 1040 forms for the past 3 years, and 3 W-2s. You have to be "bullet-proof" with tax returns.
