i have seen just another case like this,and the beneficiary was from a third world country with a freakin slow system.i wouldnt buy much into it,looks like an excuse letter

Well Ruby and I received our answer on the service request filed Feb 18th. It came in the mail today. Our original I129f was filed August 30th, case touched once in December and then nothing until now.

Here is what the letter says:

The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.

Until the background investigation is completed, we cannot move forward on your case These background checks are required to be completed on all applicants who apply for immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us with 6 MONTHS of this letter, please contact customer service at the number provided below.

Ok, so it's been 6 months 11 days. Our case is one of the last ones from August I see on Visa Journey.. Has anyone ever heard of this happening? Is this a stall or the beginning on a turn down.

Any advice or help or comments would be most appreciated. We are devasted.

Your case was opened for adjudication in December. Had it been "clean" you would have had an approval then, 20 minutes after it was opened. Instead you got a "touch" (Why on earth people think that is a good thing is beyond all comprehension)

Something turned up in their usual 30 second background check that now has to be manually investigated. I do not know what.

EVERYONE gets a background check, for most people it takes less than a minute. For some it takes hours or days, for others it takes months. It all depends on what is investigated, by whom and for what. Incidentally, the information you provide on the G-325a can often separate you from some bad guy that has the same name so it is good to fill it out completely.

What they told you is neither BS nor is it the beginning of a denial. It is exactly what it says and NO ONE, not a congressman or Senator or anyone can make them process it faster if it is being held up pending background checks. You are just unfortunate in this happening and I am sure it will be cleared up. If you or your fiancee have never done anything to be disqualified, you WILL eventually be approved.

Other senior VJ members state the entire background check takes all of 5 minutes. I call BS on USCIS. I don't think they want to admit that your petition is laying in a big pile across the room.

it takes less than one minute if it is a clean record. I am not guessing at this. His background check was not "clean". This DOES NOT mean he did anything wrong. it means that the information they have cannot definitely separate him from someone with the same name (for example) that DID do something wrong.
