I only spank the kid and did not send him to the hospital or broke some bones, I know what i did was wrong and I learn from this, I have a familly now and can tell you i'm very happy and yes i,m really sorry for what I did, is not a single day i think about it, my step dad used to beat me up badly everysingle day sometime for no reason it all, and when you growup you carry that in side, is hidden and when it comes out is very scary you feel you have let you self down, when I was in jail I try to kill my self just thinkig I was just like my stepfather,I was scare to build a familly, but something in me said "you are not a bad person you just made a mistake, but is up to you to change and that is what I did, i'm not traying to scuse my self, but we all need to have a chance to prove you can really change like I did.

So you re married and your now US wife wants to sponsor you?

You are going to need 2 Lawyers, a criminal one to get the Felony reopened and an Immigration one.

You have been given a good link for waivers and Mexico.

Joe,

I don't know you and don't want to be judgmental but based on following this thread, it sounds to me that you "spanked" your ex-wifes kid enough to have a felony charge. You state that you've never done this act on your own kid but somehow found enough anger to not only spank someone elses child but clearly it was enough to have the police involved.

You state that you've changed and unlike your stepdad and yet you did a similar act on a kid(ex-wifes son which makes you his step dad).

It's easy to sugar coat it by saying you didn't break any bones or put the kid in the hospital as though that is worthy to be considered a felony. The fact I got was that physical abuse and violence must have played a role to warrant such punishment as jail time and legal retaliation.

I'm sure the proper decision by the courts or INS will prevail once all the facts are fully presented.

clearly this poster does not know the law

once the appropriate amount of time has passed(usually max of 90 days) from conviction a crime can not be reopened or appealed. Unless there is something "new" and the person is incarcerated. As you are not, you are a felon...which is possibly non expungeable due to it being a violent felony.

That being said, good luck....your ex wife screwed you over.

Clearly you do not know your ####### from your elbow.
