HELLO EVERYONE

last week I send my file for AOS.I sent my I-765 with the I-485. I send a check with the I-765 even tough I do not have to because it is going with the I-488 (my big mistake)

question: is there a way I can get that check back? or is it possible USCIS can send it back or do not cash it?

I read a posting last week where USCIS did send back the check for the I-765 to the filer when they had sent check for both the I-485 and I-765.

I am almost 100% certain you will get your I-765 check back.

Sometimes they'll send the entire packet back but I have heard of them just sending the additional check back.

I think if you sent a separate check they will send back that check. But if you paid the fees using ONE check they will send back your entire package along with the check and ask you to resend it with the appropriate fees. But if you sent separate checks they will send back the check for the I-765.

January 28, 2011- Mailed off AOS package (Day 0)
January 31, 2011- Received a Chicago Lockbox (Day 3)
February 8,2011 - Received Rejection notice due to incorrect fees (Day 11)
February 9, 2011 - Resubmitted AOS package with correct fees (Day 12)
February 11, 2011 - Fedex Delivery confirmation signed by S.BUSH. (Day 14)
February 15, 2011 - NOA for I-130, I-485, I-765 received via email (Day 18)
February 19, 2011 - Got biometrics letter. Appointment for 03/10/2011 (Day 22)
February 22, 2011 - Received NOA hardcopies I-485, I-130, I-765 (Day 25)
February 23, 2011 - Walk-in biometrics was successful. In and out in 10 mins. (Day 26)
February 24, 2011 - Contacted Congressman rep regarding EAD expedite (Day 27)
March 7, 2011 - Contacted Congressman rep regarding EAD expedite. Informed rep that I had just received a job offer. (Day 38)
March 7,2011 - Received email from USCIS card/document production (Day 38)
March 10, 2011 - Second email notification for EAD (Day 41)
March 11, 2011 - Third email notification for EAD (Day 42)
March 14, 2011 - Received interview notification via email/text for April 19,2011. (Day 45)
March 16, 2011 - Received EAD. (Day 47)
April 19, 2011 - Interview APPROVED (Day 81)

February 23, 2013 - Received NOA dated 2/19

They will most likely send it back due to incorrect fees.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
