Part 9 N400

Hi there,

I am not sure about this question but I did listed my 2 stepsons and counted them as my childrens on Part 9 of the N400. I wrote "4" where it asked "How many sons and daughters have you had?". I don't know if it is ok because they don't live with us but I have been married to their father since they were 8 and 6 respectively now they are 19 and 17. In conclusion, I listed our 2 sons and my husband's sons from his previous marriage as my childrens. Also, in the F2 section of the part 8 there is a question about my husband's ex wife it says " Prior spouse's Inmigration Status" . She is a US citizen now but when she was married to my husband she was a LPR that she got through her parents. Which Inmigration Status should I check: US Citizen or Lawful Permanent Resident.

That's what I thought but in the instruccions of how to fill the form says:"The Inmigration status she had when she was married to my husband" so this is the p art that confuse me :wacko:

you are confused. Take a deep breath.

Part 8, F2 does not ask about your husband's former spouse. Girl, this is your, not your husband's, N-400!

Part 8, F2 ask about your "prior spouse's immigration status." In plain English: if you, not your husband, had been married before, what was your previous husband's not your husband's wife's, immigration status?

If you have not been married before getting married to your current husband, the answer to this question is an "N/A" already at F1 where the qualifyer is: "If you were married before . . . ."

Now, Part 8 number G asks about your husband's former spouse. In G2, it asks about your husband's former spouse's immigration status, and if she's a US citizen now, then the answer is "US citizen" even if she had been an LPR and a visitor or student before.

Again, we live in the present.

Surely you been through all this before with the AOS and ROC stages, but as our once famous president, Reagan said, "here we go again."

Wifes' IO did comment on the number of kids we had, hers and mine, but only showed a partial interested in her daughter with an alien number that was living here. But quickly lost interest in her as she was barely over 18 at the time. But the instructions to state to list all of them so you do that.

I was dead positive had to show my divorce papers, information about my previous wife, and our marriage certificate during our AOS, but here we go again. Wifes' IO wanted to see my original divorce papers we brought along. One big difference was I was permitted to attend our AOS, but kicked me out during her citizenship interview. Think if they want that information on me, should be there to explain it. But was up to my wife to explain, so make sure you know your spouses history.

Never wanted to see that during our I-751 stage, just that we were paying bills together with several notarized letters of affidavits. But didn't ask for those affidavits this time, just our joint paying taxes together, legal joint ownership, insurance, bank accounts, and other kind of joint bill paying. Must be that a couple that pays bills together, stays together.

I feel the information about me was to make sure I was not in the business of marrying immigrants to bring them over here. If I was, figured with the risk and cost involved, would have to charge each one about two million bucks each. Also explains why my wife said her file was over 3 1/2" thick, essentially all the same information submitted three consecutive times.

But ours is not to reason why, just do it. Wife was never asked about my ex spouse, but her IO could readily see her name was on my divorce papers. But I swear we already went through all that before. Must have a poor memory.

And after 12 years of marriage I don't think that my husband's prior spouse information will be relevant here. Even that I am not applying for the 3 years rule I am taking my marriage certificate and my husband's divorce decree.

:lol: Thank you Bob! I was nt wearing my reading glasses . I hope to join the march filers tomorrow. I am getting very anxious for nothing. BTW,I love Germany I lived in Friedberg for almost a year when my husband was in the Army, too bad that when we got married He just had 9 months left there.

Has five downloads,

Shows the evidence you have to bring for the five year, not very much. We were tempted to wait for the five to save wear and tear on my copying machine, plus all the time it took. We really couldn't say goodbye to the USCIS, as my stepdaughter just turned 18, so she could not tail gate her mom. But did have strong hopes of those long visits to her foreign consulate to make the effort worthwhile. But then her US Passport had her place of birth on it and for that reason, she still needs that foreign passport to visit her mom. So really not much was gained by us doing the three year.
