Question regarding "IV Expires" date and expiration of my wife's Green card

Here is my question...

My wife has been with me in the US since September 16,2009, her visa says it is a CR1 and at the bottom of the visa it says "IV Expires on" 19FEB2010. So, does this mean her VISA is no longer valid, and she cannot travel out of the US?

p.s she does have a green card (permanent resident card) and a Social Security card. She has had them for quite a while now.

Lastly, one more quick question...Her green card expires on 09/16/2011. What do we have to do now so that she can stay in the country past 09/16/2011?

She needs the greencard to travel out of the US, nothing else. If she has that and it is not expiring she only needs her passport to go.

Happy to help.Your wife obviously arrived in the US before your second year wedding anniversary, hence she got a CR visa category which means Conditional Residency.The visa pasted on her passport when she arrived in the United states is only valid for 6 months so that accounted for the expiration on her Visa.You will need to file for the "Removal of the Condition" Placed on her green card cos its only valid for 2 years under CR1 category.Try to read more on here about removing conditions on green card,after this is successful she will get 10 years green card.You must file for this by June 16th this year which will be exactly 90days to the expiration.Note:This is the Rule.I will help you out with more information later cos I have got to go now.I am very sure that other VJers will be able to help you out.Smile

You said we have to file BY June 16th, so can we apply for the condition to be removed BEFORE June 16th? e.x. Could we do all the paperwork and send it out next week?

No, it can be within 90 days of your expiration date.

It CAN be any time between the 90 days out and the day before your greencard expires (although that would be cutting it close). It MUST be filed before it expires.

Just look at the guidelines for removing conditions on this site! It's not hard to understand.

It is very important to do the removal of conditions; if she fails to file in the 90 days time frame she WILL lose her GC!

It is 90 days (not three months) prior to the expiry so if the card expires September 16, 2011 you can apply as early as June 18, 2011 but it MUST be received before it expires on September 16, 2011. Good luck!
