How to Write to a Congressman or Senator

Hi everyone,

I want to first say that this is a great website and has help me so much in my K-1 Visa process. I am about 3 and half months into my K-1 process so still a ways to go, but I see that a lot of people contacting their state representative or state senator for help once they pass the 5 month range. I know we should probably write to them and not call them. But what do you write in the letter? Is there is sample letter on the website? Can anyone give me advice on how to write this letter because I a pretty sure I will, like most others, be going over the 5 month time for my NOA2.

I've always been curious about this too. I saw one a couple months back that was sent more with emotion than with logic. Anyone willing to post theirs? Would be a nice addition to the sample forms found on this site.

I saved that action for the Consulate decsion. Fortunately I didn't need to use it, but in investigating what to do, I found a US Senate website that lists Senators offices (I don't remember the exact address, might have been ussenate.gov, or something like that.) Some sites are better than others, but one of my Senators listed a staffer that specialized in visas. There was an e-mail link to contact the Senator that sent a canned response back, but was later followed up by a staffer. Usually they will require a privacy waiver and copies of what you have provided to the agency (and probably all other precedant agencies.) Fortunately I didn't nee to use this route.

Find out who your congressperson is. Representatives work better than Senators mostly because senators are "too busy" to deal with us peons.

There is generally a form on their website that asks you to fill it out and send it back to them so they can work on your behalf. I emailed a form, but I also put one in the regular mail. I heard from the congressperson's assistant-- they have someone who does all the immigration stuff for them-- after about one month. She did finally call USCIS and all she really did was look up my case number and tell me I wasn't over the time limit yet. But if you are over the limit maybe they can help you. Once my case was approved she sent me a congratulations letter even though she did nothing to help me get there. BUT! glad I made the contact, because who knows what is going to happen at the consulate and DOS.

You can write whatever you want! I would suggest calling first to find the name of a specific person in the Representative's office that handles immigration issues. I received a reply in 2 days with the status of my case from the USCIS after sending this email:

Dear Mr. XXXXX:

Per our conversation yesterday, I have completed and attached the Privacy Release Form from the Congresswoman's website allowing you to make an inquiry to the USCIS regarding my case. I have also attached an electronic copy of the I129F Petition for Alien Fiance(e) and the I797C Notice of Actions notification of receipt of the petition.

To refresh your memory, my petition was sent in September and the original I179C is dated October 1, 2010. It is the stated goal of the USCIS to process these petitions within five months. My case was received by the USCIS on September 30th and has yet not been adjudicated, and therefore is outside of their "normal" processing times.

I am aware of a large number of cases that have been adjudicated at the California Service Center that were submitted in January and February of 2011. According to several of these individuals whom are members of VisaJourney.Com, they did not ask for expedition and were not entitled to any special handling. In fact, one individual apologized to the forum community for winning the "Petition Lottery" when others have been waiting patiently for an answer. While there may be circumstances that prevent every petition from being processed in exactly the order they are received, processing this far out of order is unacceptable.

My hope is that you can inquire as to the status of my petition, and request that they process it without further delay. I appreciate your attention to this matter and thank you in advance for your assistance. Please don't hesisate to call me at xxx-xxx-xxxx if there is any additional information I can provide that would be helpful.
