If I do not get my NOA2 tomorrow, then the officer who has my case should get an earful from SOMEONE on Monday. Saturday marks 30 days since my case was assigned to an officer (and they said it would be adjudicated in 30 days). And 5 days since I requested an expedite (and they said they would get back to me within 5 days). But I don't expect to hear from them.

So, here's the plan. On Saturday morning, I am sending out FOUR letters: one to my Congressman, two to my Senators, and one to the USCIS Ombudsman. I hope that these letters will arrive Monday. I plan to call all these places Monday as well. This is the second time I am contacting my Senator. The bulk of of my letter is below. I described my situation and then added this:

"I know that I am not the only one who has experienced a delay in the processing of my I-129F petition. Petitioners who call the National Customer Service Center after 5 months are told that they must wait longer because there is a backlog of I-129F petitions. This is disconcerting because the director of USCIS Alejandro Mayorkas stated in a press conference on February 17, 2011 that “I believe we have eliminated our backlogs.” (See attached print out #1). I feel that it is imperative that you, as [the USCIS Ombudsman/ my state Senator/ my Congressman], are aware of the abnormally long processing times at the Vermont Service Center for I-129F petitions, particularly if these delays are not being acknowledged or addressed by the Director. The number of approvals in the fall of 2010 was exceptionally low, and in December 2010, USCIS processed fewer I-129F petitions than any month in the previous 2 years, even though application receipts remained steady (see attached print out #2).

I can think of no other explanation for this trend except that many I-129F petitions were set aside for several months to put priority processing on other petition types. As an institution that is funded almost entirely by user fees, I find it unconscionable that K1 petition filers – who are all U.S. citizens themselves and who were paying $455 to file the I-129F in September – could be moved to such a low priority for such an extended period of time.

That said, it appears that many others who have submitted their application at the same time as mine or after mine have already been processed, at both the California Service Center and the Vermont Service Center (see attached print out #3). I have waited my turn and, given these trends, it should not be unreasonable to request attention to my case, as well as the others who submitted their K1 visa petitions around the same time and have waited patiently."

I included printouts of the transcript of Mayorkas, the USCIS website processing trends, and visajourney petition trends, as well as a copy of my NOA1.

If this doesn't work, I know I have tried everything within my power.

First of all best of luck, still hope you ll hear something tomorrow ! Being in a same boat (Tuesday marks 6 months for us) I dont have any mercy for VSC no more. Was playing with case numbers yesterday, (had kinda shock after) its amazing how many TPS petitions were approved straight away, tones, thousands, leaving behind i-129f, and yet as time passes no real adjustment - moreover they got worse - from 30 days delay to 47. I live in one of the most bureaucratic countries with low customer service and yet everything before can not compare with this neglection. On top of it, those people should know tht lies about "no baclogs" may lead to some action against of them.

Sorry for few more lines of complaining. :) lol... had to say tht. :blush:

Milushka, why do you think that people up to 9/14 are mostly processed? It looks to me like they mostly just dropped off to "past due" part of Igor's list. :(

USCIS obmudsman - did you use the snail-mail form on the dhs site to get his attention, or is there a better way (fax, phone or email)?

There are around 55 filers from that range. 30 of them been approved which. Even though it looks like half of them still awaiting, almost all "active" users we know here got their NOA2. I repeat from tht range. Do you find it over optimistic?

Realistically, it might take March+good half of April to get through the whole month of September at current speed.

Alejandro Mayorkas is a major toolbag and a huge part of the problem at VSC (along with Hillary and Napolitano). Hope to God he gets canned, very very soon.

When you give them an earful on monday, ask for the same ISO you spoke to (if you know his/her name) who said you would have it in 5 days and ###### them out for lying.

The way USCIS acts sickens me. It is their ineptness (among some other agencies) that continues the stereotype that all government workers are lazy and do nothing (a lot are, but a lot also bust their butts everyday to get their jobs done).

Hey guys, I was just wondering what part of Igor's list you are looking at. I just go to timelines and then get a view with a long list of petitioners in order of their NOA1, with the last 15 processed at the top - and someone else said they could see the last 20 processed. Are there other views I don't know about? I don't see who's "active" or "past due" or anything. Let me know if so - the more info the better! Thanks!

we have waited a lot longer. I wrote and asked my senator for help last April. When you call immigration all you get is someone who can give you general information. You do not get to talk to your case officer. No one does.

Not sure how Hillary would affect USCIS, and nothing has been mentioned here about the major transformation initiative USCIS is going through. They are updating systems, being audited and making major business process changes.

USCIS is not Walmart or Geico. They are processing more than one application type and regardless of how much you rattle the pots and pans, call them email them and contact third parties, they have a finite amount of resources and personnel to handle the total number of applications world wide.

Your application type is probably closer to the overall "goal processing" time of 6 months than most application types. Flip around the other forums here on VJ and you will start kissing the ground for a turn around time of less than a year. Some application types are taking over a year.

When they get the other types caught up maybe you will see an increase in turn around times.

USCIS is not Walmart or Geico. They are processing more than one application type and regardless of how much you rattle the pots and pans, call them email them and contact third parties, they have a finite amount of resources and personnel to handle the total number of applications world wide.

Your application type is probably closer to the overall "goal processing" time of 6 months than most application types. Flip around the other forums here on VJ and you will start kissing the ground for a turn around time of less than a year. Some application types are taking over a year.

When they get the other types caught up maybe you will see an increase in turn around times.

You do know State Department mandates what nations in need of help right? As well as the President.

Please don't tell me how the process works, I know how it works and I know who is in charge and who makes the calls.
