One of the only things that I worry about with the whole application process is the length of time I'll be restricted from leaving the US. My mother is quite ill (back in Canada) and its always unpredictable with her. This is the first time in my life that I will actually be unable to get back to Toronto should anything happen. Our lawyer suggested that obtaining a letter from her physician to include with the application will allow us to request expedited service - I was just wondering if anyone has done this (or something similar), and if it worked?

Moving to Work/TRAVEL during immigrations.

Yes they do issue AP quickly if given an urgent reason, you can also in an emergency providing evidence, visit USCIS field office, and they can issue AP on the spot.

Thanks! Sorry for the wrong forum - still learning my way around :)

Now what do they consider an "emergency" and what is evidence? If I get a phone call while I'm still waiting for AP that my mother has been hospitalized and the doctors think the outlook is bad, realistically to go to a field office and provide evidence etc. probably wouldn't be very helpful at that point, no?

A letter from a doctor stating parent is gravely ill would be considered to be an emergency.

I have seen people visit field office and sweet talk an AP doc out of them before, they are not out to be cruel.

One thing I do point out about K-1 Fiancee vs CR-1 Spouse is the CR-1 gets green card upon arrival, and the K-1 tends to get frustrated being not work authorized, and land-locked (Unable to travel without AP)

Evidence is proof from the doctor in the form of a letter generally. It outlines the condition, the severity, longevity etc. If any proof is obtainable from the hospital that can be included as well.

Include the proof and write a letter requesting expedited AP. You would write the letter saying shes very ill you have included proof and she is in and out of hospitals for treatments etc etc and you need to be there with your mother so you are requesting expedite AP in case of emergency so that you are able to travel back to Canada and be with her when she is in the hospital.

They may or may not grant it. Have a copy set up in case there IS an emergency and make an infopass appointment right away and request an AP stamp in your passport so you may travel to Canada if she has taken a sudden turn before you get AP or GC.

The Advance Parole is allow reentry, not departure.

It might make more sense to apply for the AP along with the Adjustment of Status and then make an appointment at your local USCIS office to request the emergency/expedited AP. Bring anything that you have from the doctor, etc to the appt.

This was pretty much my situation. My Mum had been in and out of hospital prior to my departure for the US. Not long after I got here she was back in hospital. I made an InfoPass appointment and presented letters from the attending physician and the hospital. They approved it and called me the next morning saying my AP document was ready to be picked up. Good luck. I hope your Mum stays well.
