Hello,

I have been a long time viewer of the forum and appreciate all the great advice here as I try to put together the AOS application for my husband. Usually I am able to find all the information I need through the search but just came across something I couldn't find an answer to so finally decided to post myself.

Some background on us: My husband entered the US on F1 visa in 2007. His visa is still current (another two years or so) and he is in good status at school. Until the end of 2010 he was working and filed tax returns with his SSN. Once engaged I encouraged him to stop working and he has since quit and remains a student at language school. Since, he received a job offer that would begin around Aug-Sept which influenced our decision to apply for AOS.

We were recently married (Feb 1st) and were hoping to have a reception in Japan, where his entire family and half of my family live, in late July.

I am almost ready to send out our application and I was hoping we could go to Japan with AP once approved. Recently speaking with a friend, I was told she knew several people who were denied re-entry in the US with AP documents in hand. While my husband has never overstayed (which seems to be the common cause for denial), I wonder if things like working in the US could cause problems with re-entry? He has never had an issue with immigration in the past.

Yes overstay of 180 days or more is the cause of denial of entry even with AP doc.

If not in an overstay situation, then should not be denied re-entry.

AOS from a valid F-1 is a low risk situation, intent does not come into play, intent was to go to school, which is still the case.
