If I understand the question, the process of the CRBA does not depend on whether the parents are married or filing K-1. What matters is that at least one of the parents is a US Citizen and the birth occurred outside the US and its territories. If both are true, a CRBA is required. If the parents are married or filing a K-1 it should be a simple matter to obtain the CRBA although a DNA test might be required.

I have one friend on here who had divorced the US Father and she is outside the US with her daughter. The Embassy won't giver her a K-2 visa to bring the daughter to the US, they insist she report the child as a CRBA. To report the child as a CRBA she needs paperwork from her ex-husband US Citizen who is now in the US and is being a real ba--ard and will not cooperate for the daughter's sake.

Good luck

Hey there,,disregard my other reply to ur other post. I just found out this info which i hope may help u.

First thing you do is call the American Citizenship Services to have the forms delivered to you before u will have to make an appointment with them.

Make sure u have all the needed forms signed and needed documents available before you will set up an appointment.

here's the # to call: (63)(2) 897-4747. You start from there and start getting all the doucments u need.

You will need:

The USC (Child's father) prrof of US citizenship

Child's Birth crtificate

Marriage Contract if married

You need hospital records as they asked it from me when my baby was born.

Good luck!
