My husband lives in Jamaica I live in Georgia my husband and I 1 year wedding anniversary is coming up on May 10th

He wants to take off work and come visit me. Mean while I filed the I30 form for him in November and we are still waiting on approval. Is it possible that he can come visit me on a visitor visa? any success stories in doing this and what all would he need to prove that he will go back home after visiting. My husband works, take care of his daughter, and have a valid passport. What do you think should he do it??

Our experience may not be comparable but I'll post it anyway. We have applied for a K1 and she has traveled here without issue on her visitor visa. However she had her visitor visa before I sent in our I129F. As you say its important to prove the intent to return and not immigrate. She had to go through a secondary interview on her last trip but it only took a few minutes. Honesty is important. I say go for it.

Anyone can apply for the visa, to get one you have to prove you have strong ties to your home country. WIthout this proof the visa will be denied. It is more common to be denied than approved if you are visiting your fiance/husband from countries that require visitors visas. What proof of strong ties does he have ?

This will not be over quickly. You will not enjoy this.

Can he apply for B2 certainly yes he can apply for B2, second question is will he get B2 chances are close to nil.

When you have an ongoing immigrant petition they do not want you to travel on non-immigrant visa and reason is ppl have misused it to skip the line, they would enter the US on non-immigrant visa and then file for AOS from here.

So chances of him getting approved are very slim and on top of it even though he has visa officer at POE can still refuse him an entry.

The Visa will NOT affect the I130 you filed for him. If anything the I-130 is would affect his application for a tourist visa. He can use employment letter, School letter/enrollment information for the child to addend school next school term, Information on property if applicable,... like Mortgages, RECENT Loans, Auto, Land, etc.

Most people who visit whilst the process is ongoing do not require a visa or already have one.

I would be hard pushed to think of many who obtained a visa in his circumstances.

I have seen a few on here get approved for tourist visa after sending in I-130. At least 4 - so not a lot, but some. One in Philippines got a visa good for two weeks only.

So OP, it can happen. Be honest and good luck.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
