The I-94 is not a work authorization... the EAD or Green Card is work authorization.

A K-1 is entitled to an SSN though not able to use it to work until they have work authorization. Most SS offices turn people away it seems unless they have the EAD or GC.

An I-94 is not an authorization to work. Only EAD and Green card will allow u to work.

I am not sure how it works now but when i came here 4 yrs. ago i was able to get my SSN after me and hubby got married..all they asked from me is my marriage certificate and passport. I did not have my AOS yet that time.

A K-1 visa holder is only authorized to work while their I-94 is valid if they have authorization from Department of Homeland Security (i.e., an EAD from USCIS). The only reason this is allowed is so that a K1 will be eligible to apply for a Social Security number. In reality, nobody with a K1 would be crazy enough to actually apply for an EAD based on their I-94 because you have to pay a fee to file the I-765, it takes a couple of months to be approved, and it will expire when the I-94 expires. If you were lucky, you'd get to work a couple of weeks before it expired.

Anyway, SSA is supposed to issue a Social Security number to a K1 with a valid I-94, as long as the I-94 still has at least 14 days of validity remaining. Print out the following page from the SSA website and rub it in the face of the clerk at your local SSA office.

Please note that the link in the VJ K1 SSN guide is apparently now broken, but the above link will get you the information you need. I guess SSA has revised their guidelines since that link was posted in the VJ guides.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Go back to the office, or try another office and tell them to look at:

RM 10211.420 Employment Authorization for Non-immigrants

https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211420

C. Policy - Employment Authorization by Class of Admission (COA)

The following policy applies to employment authorization by class of admission:

1. Aliens Work Authorized Without Specific DHS Authorization

The following sections list non-immigrants, by alien class of admission codes, who are authorized to work in the U.S. without specific authorization from DHS. The person’s I-94 will not have the DHS employment authorization stamp and the alien will generally not have an EAD.

K-1 -- Fiancé(e) of U.S. citizen
