MY wife is here on her K-3 and her interview for her visa is next week.

My questions are

- What is the visa she will be getting and what will I have to prepare with?

- Her friends who also have done the same interview have mentioned and insisted about an affidavit from family and friends that we are living together. What is this thing supposed to say so I can get it all typed up, signed and notorized?

I have posted in an earlier post about this and explained to my wife we wont need it, so I guess I will have to do it anyways.

Can anybody please help??

And if aussiewench is out there, I would love your words of wisdom, you haven't failed me yet!!

if she's already here in the US with a K3 visa, the interview you are preparing for now would be the green card, not another visa. Depending how long you've been married, it'll be either a 2 year conditional card (if you've been married less than 2 years) or a 10 year card (if you're married more than 2 years).

Affidavits from friends and family are not absolutely necessary unless you have absolutely no other proof that you're living together as husband and wife. Evidence such as both names on household bills, and/or insurance in both names, and/or bank statements in both names, etc etc etc. If you don't have any of that, affidavits from friends stating that they know you as husband and wife, and they know you to be living together at the address stated may be helpful. Everyone's experience is different tho.

You'll also need to prepare another affidavit of support (form I-865) with updated letter of employment, and you will want to bring along copies of your latest tax returns, and anything else that you have sent USCIS up to this point and both of you will need to bring ID and passports. You may need it you may not, but its better to be prepared than be denied.

Best of luck. Its usually anti-climactic.

Being that my wife cant have any accounts or names on bills because she doesnt have a SSN I guess the affidavits are the only ways to go.

Now I am just wondering what the affidavit should say, what the form should be. I really have no clue on how to write this.

Please help!! Im running out of time.......!!

Why didn't she get an SSN? Didn't she get an EAD? Just curious. You *can* get some banks to add her to a joint bank account without SSN. Also if you have insurance, some will add her without SSN. She can even get a driver's license without SSN, all she needs to do is sign a standard affidavit that most banks and DMVs will have that says she does not yet have an SSN because she is ineligible.

She finally got an EAD appointment last week, something is wrong where it was over 100 days since they recieved payment and application for the EAD. Right afterwords we went to the Social Security office and that is where they told her it will be 4 weeks till she will be issued a number.

As for my bank, there is no way that they will add her without the SSN. The state of Illinois would not give her any other option, even for an ID card, other then get the SSN then apply. She is pretty much stuck. I did get a Credit Card with her name on it, but only Capitol One will do that. BOA and HSBC will not without a SSN. Cingular Wireless is now under both our names now, but I cant get a bill ontime for the interview.

I just hope what I have is enough. The CC and Cingular account. Everything else is in my fathers name since we live in his house (I am helping with the huge remodeling project)

Your profile shows that your I-130 petition was approved about 6 months ago and that your wife has an adjustement of status application pending. Are you really writing about a visa interview, or are you writing about an adjustment interview?

Too bad she can't get a BoA account in your state. I've had one in WA for a few years now, with no SSN expected or required.

I think you will find that most states now do require a SSN in order to get a bank accnt. and that is if your credit is good. I have not so good credit and even to get a bank accnt. is a nightmare. I feel for the OP really. Although, I have never heard of needing a SSN to get a state ID card or license.

TIMELINE

I tried to print the bill and there is no indication of her name on it. Darn!!

But good news, we were approved with what little evidence we had. Thank you eerybody who answered my cry for help!
