How Long outside US with 1st Green Card

Greetings To Everyone:

I believe that my wife cannot be out of the US for more than 6 months on her 1st green card. But I really wanted to post this question to verify my thoughts / research on this matter. I do not want her to have issues coming back in. Another part of this question is this: I will be meeting her in China along with our son and all coming back together. So, upon entering the US can we ALL get in the US Citizen Line for our beloved Department of Homeland Security? :wacko:

Your wife can be outside US more than 6 months, but less that 2 years...IF she has a re-entry permit. She should have no issues coming back to the US within 2 years.

When I arrived with my wife (who is an LPR) at Sea-Tac, we were advised to fall in the "Alien" line. Yes, even though I am a USC, I was advised to accompany my wife in the "alien" line...as opposed to standing in separate lines.

Reentry permit is only needed for absences of 1 year or more.

Your question misses the point. A lawful permanent resident of the United States is allowed to permanently reside in the US. She is also required to permanently reside in the US. That does not mean that a LPR can't travel internationally, take a vacation, visit family, or take care of some unfinished business.

But try to approach this with a portion of common sense. How long a vacation can a non-millionaire really afford? Assuming your friend isn't wealthy like the Kardashians, she most likely has to be back to work after some time. But maybe she doesn't work, maybe her husband is a multi-millionaire, traveling the world in a private Lear jet and wants her to join him. All dandy and fine, and not a problem, as long as the story makes sense.

What the immigration people don't want is Green Card holders who live outside the US and just visit the US frequently to keep their residency alive. Thus, USCIS will usually not question the immigrant's motives up to about 6 months absence from the US, unless there's a pattern of her traveling in and out. This is easily detected as every time she arrives at the POE, her Green Card is scanned and the data is entered into the computer system based on her A-number.

Once the absence extends 6 months, it's possible that CBP will inquire about the lengthy trip. If she then proves that they have homes in Beverly Hills, New York, Monaco, and Paris, and also proves that they have tons of disposable money to burn, not even a longer absence will be made an issue. Again, use common sense and she'll be fine.

We'll her trip will not exceed 4.5 months and I'll be going over to be with her to visit and do the tourist thing in Beijing, etc. We will all be coming back together, So, I think we'll all just get in the US Citizen Line. Maybe with an infant screaming after a 10 hour flight, I'm sure they will be happy to get us out of there.. Maybe.. :blink: Thank You again for the help, as always.
