Issues when Wife is Not willing to travel

Hi all,

I thank you all for the advice you may give to me.

I have requested my brother, ando also my mom requested him 5 years ago, but he had to wait in queque...

now he is on the process.

Then I've managed for he and his family (a son and his wife) their green cards. But his Wife is definitely not coming here for some Reasons, main of them is that she doesn't have closest family members here, so she decided to stay in her hometown and not coming here today nor in the future.

I'm glad to know if there will be some problem for mi brother to come here just with his son without his wife.

Maybe problems caused by their Passports, or maybe inmigration staff only allows both married, or something related.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks for answering mi question. I would also like to know how much time his son can stay in his homwtown after being approved, because he is finishing his Stats career there and wanted to go there having this finished.

If the son is a minor and the mother is not traveling... then a letter of consent from the mother will be required!

I have seen cases like this before and the mother or father who decides not to immigrate always complicates things … and then more often than not they end up regretting it and wishing there was a way to fix things up later on.

No matter if the mother wants to come or not, If the son is over 21 years old, then most probably he has aged out and will not be able to get a visa based on his father´s petition (F3 or F4)… sorry!

He can stay in his hometown for 6 months AFTER he is approved.. there will be a date in the visa / expiration date. He can travel before it is expired and if he needs more time he can go back to his country for another 6 months without issues.

Dec 24 2012 - Case Complete

May 17 2013 - Interview-Approved

July 19 2013 - Enter the USA
