My father a US citizen is deceased. He filed for me in 2005. I have been a LPR for almost 6 years. I am in the process of completing the N-400. However, I only have tax returns for 2010, 2009, 2008, & 2007. I did not work in 2006. What can I do for that missing return? It is my understanding that I need the last 5 years. Should I write a letter and get it notarized? In the letter, I will explain that my father was the sole care taker. Please advise.

This is a common topic, returns only needed to be included if, basing N-400 on three years of marriage to a US Citizen, or if you had been out of the country for a period longer than 6 months in the past 5 years.

You bring the returns with you to the interview.

If you did'nt file 06 taxes then go to your local uncle sams office and back file taxes for 2006.....they won't put you in jail .....then get a tax 06 transcript and tax return if possible there and then...

Make copies of everything then add copies you have made to your N-400 application.....again inportantant make copies of everything)

If you filed 06 taxes

Tax transcripts are easy to get - http://www.irs.gov/t...pics/tc156.html you can either fax the request in or call the 1-800 number and with the rep order the transcript. If you're next to a fax machine, they can even fax it to you and make sure you have received it.

If you order over the phone that could take upto 14 days to receive....best bet go to your local uncle sams house (IRS) if your close

It was exactly 26 days ago my stepdaughter had her five year interview, prepared her with tax transcripts, her IO didn't even want to see them. But you know the USCIS doesn't exactly follow their own rules.

Go to http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=480ccac09aa5d010VgnVCM10000048f3d6a1RCRD&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1RCRD and read the requirements. Have an evidence check list, the instructions, and the M-476 manual, nothing about tax returns in those for the five year.

Luck is having a knowledgeable non-hardass IO.
