K-1 Questions...Trying to understand...

Hello everyone,

I've been looking around the internet to find answers to my question and have stumbled upon this website, which seems very helpful and friendly.

I have several questions if anyone could help me gain more understanding of the process, I would tremendously appreciate it.

I am currently a university student in KS. I've moved here to the US with my mother via the K-1 visa, I believe, and thus have gained my permanent resident here and in the process of naturalization.

Anyhow, I am in a relationship with a man of British citizen. Although he is from the UK, he is currently living in the UAE using the work visa that allows him to live there under his employment. So basically he's been living there for years now and I don't think he is planning to move back to the UK anytime soon.

We are deeply in love and we plan to get married someday. I'd to be realistic and think towards the next few years since I'd like to obtain an grad degree, so I'd like to know a few things...

1). Since I'm a college student and I have to do student's loans to pay for my education, once I'm out I'd have over 20K in debt which I will be paying. At that time I'd be making pretty close to 20K a year in full-time. I might go for two jobs and try to save up while repaying back the loans. I'm thinking about working a full year before filing for the K-1 visa. Will my school debts be a negative factor when filing for the K-1?

2). We are currently 21-22 years old. So by the time, hoping by age 25 we'll be filing for this. Will our age be a factor in the process? We've met numerous times before and deeply in love, but I fear that they might rethink our situation because of our age.

3). How about his current location? He's a British citizen working the UAE (Middle East - United Arab Emirates)...Will this be a problem? Will he need to move back to the UK after I've filed for him?

4) If I make around 20K income for a year after I graduate, will that suffice the requirement? I know they have to consider for sponsorship to make sure that I have the financial capability to support him. Although if he does get his perm. residency, he can start working, which is what my mother did when she came here.

I would really, really like to get your opinions on this from anyone with experience. We're seeing each other every 6 months and we've known each other for over 3 years, so I'd like to understand the process more and we could do to increase the appeal.

1) They don't take debt into consideration during the process.

2) No, your age will not be a factor.

3) He could be interviewed at either consulate. It is up to you both to choose, and put it on the forms. He should interview in the country he resides in at the time of his application.

4) The poverty guidelines change year by year. As of now, at $20k per year, you'd make more than enough for a K1 petition (which requires an income that is 100% of the federal poverty guideline). When the time comes for him to adjust status, you will need to make 125% of the guideline. No one on here can tell you what the guideline will be in 2-4 years.

You probably already know, but just to clarify you will have to be a citizen first to file for a fiance visa.

He'll need to get a police certificate from every country he's lived in after the age of 16 and it'll need to be dated within 1 year of his interview. Keep this in mind and check current protocol at the time of applying. I believe some middle-eastern countries have very arduous ways of getting these, so better be aware of the process in case he does decide to move back to the UK and then finds he has to travel to UAE to get it, for example.

No one can really advise you properly about policies and procedures for something that is going to be happening 3-4 years from now.

At present, the fairest truth is he'll probably have an easier, quicker time of things if he applies through London. But talk to people who've been through UAE and sound them out about the process.

Keep visiting each other, keep ticket stubs and evidence of your relationship and keep watching the forum for changes that could affect your timing decisions.

I have another question...

Let's say I'm planning to attend a graduate program in about 1-2 years after my graduation. At that time I should have enough money to sponsor him. Do they only need a year worth of income from me or do they look at your income from say...2-3 years prior to filing?

So say if I get into the program, which will be expensive, I will have to do loans. And if I do get more than enough money from loans alone to cover living expenses, will that affect the process? Will they deem me not qualify to sponsor my boyfriend who will be my fiance at that time?

So if it will affect the process, it would mean that I shouldn't be attending school at the time of waiting UNTIL after they approve and he's able to come to the US?
