Canadian bf got denied at the can/us border, can he try again???

He got through today by showing addresses of where he was going and when ... and was given 2 months. I was surprised that they were that lenient since he does not have a job or house. But apparently knowing his facts, and also carrying medical insurance was a plus. Hooray! Thanks for your input, everyone.

Great news!

My advice...have him make a photocopy of his I-94 (I assume he got one when you say he was givin 5 months) and having the Canadian customs stamp it when he returns.

It all comes down to the POE officer.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I had gotten denied driving across the border with my husband 3 weeks before our wedding. but I had no ties to Canada at all because we were told A LOt of wrong information from the USCIS phone in line. I was fingerprinted and flagged, and they said I would need strong ties to Canada to try again. In our case, we were told to contact them later on (The Chief there had given us her card) and luckily for us on the day of our wedding, I was issued an I-94 lasting 1 year! I couldn't leave and come back, I was stuck in the USA but, I got to be with my husband for half of my CR-1 Immigration process!

It really is depending on the officer. If he just refused him and turned him around you should be fine. I hear it's usually cleared within 24 hours. But he needs to get a job, or start paying rent somewhere.

We were VERY lucky and fortunate how nicely it happened for us even though once I got back to finish up my paperwork it was still another 7 months before our interview!

I know someone who was given a i-94 for one year to be with her husband in California during the process. I choose to stay in Canada as I couldn;t work down there and I needed to be able to come back and forth across the border. My kids all live here and my mother is 92 so needed to be able tocome back at a moment's notice. Its hard to be apart but we are managing

He got in for 2 months! :-)

He came prepared with names/addresses of where he was going, and paid medical coverage which apparently helped a lot. Thanks for your input, everyone.

The whole issue is very "grey" it seems to me and you will get many opinions on this board.

If he didn't get anything stamped in his passport and didn't lie or mislead, then he could probably try again with copious amounts of proof of ties and copy of NOA1, etc.

But then again, the only thing I'm certain of is the process can be frustrating for those who comply with the law. :bonk:

so very fracking true. especially since i'm one of many who was refused multiple times trying to visit my Fiance. In fact during our k1 he had to visit me for the entire process which lasted well over a year. and i had tried multiple crossings too. It really is up to the poe officer to be nice and let you through or make you go through hell where you think your being arrested lol.

Glad you soon to be fiance got in!
