My husband is a US Citizen living in Canada as a permanent resident.

I sponsored him - I am a Canadian Citizen.

We are realizing we may want to move to the USA. We have no children.

Can he go through the process of sponsoring me as his spouse while still living here in Canada?

Or must he move back to the USA without me before starting the process?

You can do a direct consular filing.

12/21/2010 NOA 2 received!!!!!!!!!!! (dated 12/14/2010)

12/29/2010 NVC letter

01/12/2011 Packet 3!!!!!

02/02/2011 Sent checklist back to embassy....Waiting for phone call....

03/03/2011 She had her interview...Lacking of evidence....told her what to get and told her to come back

03/30/2011 She went back to the embassy....This time we had everything...K-1 approved; not in hand yet

Yes he can sponsor you while in Canada. He can choose the DCF if he meets eligibility and is offered or choose the normal route by submitting the I-130 to USCIS. He can reside in Canada upon until the day you will enter the USA.

Yes, however US Citizen living abroad needs to have maintained US Domicle, or will have to re-establish domicile in order to sponsor the residency status in the USA.

Is now a US Citizen immigration completed Jan 12, 2012.

Montreal is beastly against proof of domicile for the US citizen.
