Hi I checked on the USCIS website but it wasnt quite clear to me who could apply for a I-824. To my understanding this is aka Join-to-Follow

so a person who has an approved I-485 can file this for an imidiate relative skipping the I130 and visa PD wait time?? not quite sure

I am wondering if my mother who recently got her green card can file this form for me?

I am 18 and legally in the US with a visa. She already filed an I-130 for me back in oct and its still in initial review.

what are the qualifications and or restriction for those who can file for this form?

8/01/2010: Moved in together at his parents

5/29/2011: Asked me to marry him :)

7/01/2011: Started renting my sister's guest room together

7/14/2011: Got married officially

USCIS

10/26/2011: sent I-130 I-485 and I-765

11/02/2011: received Email USCIS Acceptance Confirmation for I-130 I-485 and I-765

11/03/2011: received NOA1 for I-130 I-485 and I-765

11/23/2011: Biometrics appointment for I-485 and I-765

01/09/2012: Recieved EAD in mail

02/08/2012: Interview Date (APPROVED!)

8/01/2010: Moved in together at his parents

5/29/2011: Asked me to marry him :)

7/01/2011: Started renting my sister's guest room together

7/14/2011: Got married officially

USCIS

10/26/2011: sent I-130 I-485 and I-765

11/02/2011: received Email USCIS Acceptance Confirmation for I-130 I-485 and I-765

11/03/2011: received NOA1 for I-130 I-485 and I-765

11/23/2011: Biometrics appointment for I-485 and I-765

01/09/2012: Recieved EAD in mail

02/08/2012: Interview Date (APPROVED!)

Okay you will NOT be able to gain follow - to - join benefits. That is a benefit that is available for those family members who are not eligible to have the I-130 filed for them.

These are some cases where Follow to Join would apply if they were to travel to the usa later. A copy of the Approved case /NOA would submitted etc.
