I just got off the phone with the USCIS hotline. I am so upset right now I could cry. As soon as they put me through to an operator, I immediately asked to speak to a tier 2 representative to put in a service request because my case was outside the normal processing time. The operator told me he could help me do that. I gave him my receipt number. He looked my case and told me "Actually, your case is within the normal processing times. Cases with a date of August 17 (or 21st? Can't remember) are currently being processeed. You have about 47 days to go before you are outside of the normal processing time."

I said that the normal processing time posted on the website is 5 months, and asked if that information is incorrect, and said that it should be changed if so. He told me that that time is "just an estimate" and it could be six or seven months. I asked him what the delay was and told him I was aware that the approval shouldn't take more than 30 minutes of looking at my case. He gave me the run around about how that is not true and all the background checks etc they have to do. I said I saw on the website my case has not been touched/updated since October 14, so what exactly were they doing with it since that time? He said he had no further information to give me.

I asked to speak to his manager. He told me that "all supervisors have the same information as I do". I know this isn't true. I was calling from work so I didn't want to raise my voice or make a scene. I said, "so there is NO way I can put in a service request or get this case moving?" He said no, unless I wanted to expedite it due to xyz reasons.

Very unhelpful, as I already knew he would be, just reading to me from a script.

How is it that some people have gotten service requests put in at this stage in the game? How can I get the transfer to tier 2? Any advice anyone?

I am so upset and my hands are just so tied. How is this possible. When I filed in the fall, cases were being approved in 2-4 months. Now we are at 7? How can they justify this lack of service? Seriously, I could cry right now. I have waited patiently up until now but my patience is just shot.

This is a very frustrating journey & process. They dont have to justify the level of service. I found that out during the 408 days of my case. My case was never updated nor " touched " on the web site.

The best thing you could do now is make an INFO PASS appointment & go see them in person. You will be given the personal service you need along with the latest info they have.

I suggest waiting until you are over your 5 month mark to call again. It is generally useless to call them before that. Also at that point, try and get your congressperson involved.

My senator's office is already involved. They tell me the same things - five months is still within the normal processing time - can take six or seven months and be considered within "normal" time these days.

My case is over the 5 months and a senator send an email to the VSC for our case, the answer that she got was that after the 5 months deadline, you have to wait 30 additional days for you to be consider our of the normal processing time, after those 30 days you can apply for an expedided process, because of the 6 months waiting, but that dosent asure you either if your NOA2 is on the way,because if too many ppl apply for it it's the same situation.

It is very very horrible, because there is nothing to do, and on top of that today the vermont office is closed due a bad weather condition, so no working today.

They are already late processing the ppl who apply on aug 20th, se we have a loooong wait. hang in there I know is horrible

It is sunny and clear in St Albans VT right now. Where do you get the idea that it is closed?

from the USCIS web page and another forum http://www.visajourney.com/forums/topic/299157-vsc-closed-today-tuesday/ ,but it seems that they are working , that the guy that started the conversation was wrong, because he got his NOA2 today :wacko: , maybe that is what we need to do start a forum complainig and we will get approved soon :P

I hit five months yesterday, so today when I called I technically was over my five month mark. They are now saying it doesn't matter until you are six or even seven months over.

My senator's office is already involved. They tell me the same things - five months is still within the normal processing time - can take six or seven months and be considered within "normal" time these days.

Maybe try calling them when they update their "current processing date." That should happen in the middle of the month (don't remember exact date).

9/9/10: I-129F Sent

9/15/10: Received NOA1 via text/email from USCIS

9/16/10: Received NOA1 in mail (dated 9/13/10)

9/20/10: Touched!

10/03/10: Touched to the dusty shelves!

2/28/11: NOA2 finally

3/04/11: Arrived at NVC

3/08/11: Left NVC and arrived at CDJ consulate

4/04/11: Packet 3 sent

4/13/11: Packet 3 received!

4/18/11: Medical Exam

Unfortunately, that is the ugly true. Processing times arent 5 months no more. People tend to receive NOA2 on the last week towards 6th months, some even still waiting. October filers are looking in to April. :(

Actually sounds about right for Vermont. I was right there where you are; still not approved yet of course. But I was not able to put in a service request until we were 2 days over 6 months. And everytime i seemed to call USCIS they just got more and more rude. (the last time that i called Tier 2 told me not to call back unless i did not hear something by April 14th. which would be over 8 months for us. umm what?? serious??) I think our case is assigned to the slowest person at VSC because 3 days shy of 7 months we finally got touched and they issued RFE ... just seems like we should be passed this point already. Yeah, when we put in our petition everyone was telling us that K-1s were relatively quick 2-3 months, 4 months max. So, that is what we got prepared for...had no idea what it would turn into. Just wished someone would have given it to us straight and not have sugar-coated it, hey your K-1 petition may possibly take 7 - 8 months to get through UCIS even before moving on to NVC. Now just trying to stay as busy as I can and keep my mind occupied... :blink: Just be sure to keep communicating with your SO. And make sure to do your research on the rest of the journey, as in the AOS, green card, etc. and even thinking out future plans, helps me to take the edge off a little bit. Also making sure you have done everything for easy transition for them. Just throwing some suggestions out there ... keep yer head up.

Well, maybe they should think of relocating the center to a warmer place cause looks like CSC is doing really good :) Its very frustrating to see how slow they move with the cases ... its hard enough to get mentally ready for 5 months waiting time, and now they are extending that time as well ??? :(
