hi everyone,

i cam to the state on F1 visa. i studied in California for 2 months and then i moved to Michigan i studied there a semester and then i moved to Texas. and there when i met my husband online and after 2 months we got married and i moved here in NY. at that time my husband was a green card holder,after we got married for about 4 months he applied for his citizenship.and hi got it last month . well after we got married i studied for 5 months .and i stopped going to school. after 2 months they told me that i need to go back to school because i need to keep my status , when i went back to school the advisor told me that i need to give her a medical note. so i went to a doctor but hi didn't give me a note. on my way out a women in his cabinet heard me, i thought she was working there, well she told me that she can convenes the doctor to give me a note but i have to pay her $200. As i was in need i gave her the money , the other day she gave me the note i run to the school gave it to them . but the prob is when the school got the note they called the doctor and he denied giving me the note. so the school reported me out of status.

i am worried about the interview . do you thing it is going to be a problem ? and if they ask me what should i say ? please please give me your opinion ?what should i say if the ask me about it ? and do you thing they can call the school and ask about me ?

Umm.. A little more information would be helpful. What was this doctors's note for? I don't recall needing any doctor's note for my F-1, except proof of vaccination. Is that what it was? Or was it supposed to be a note from the doctor stating you had a medical reason to stop going to school to avoid being out of status? A requirement of an F-1 visa is that you remain a full time student at all times, unless you have a very good reason to either drop below full time or stop studying all together - and a medical reason can qualify. However, since you are not in school currently (right?) and if I udnerstood correctly, also couldn't give them a legitimate reason for why you've stopped going to school, you are out of status and in violation of your F-1 requirements.

How this affects your AOS based on marriage, I unfortunately do not know. Have you already filed for you? Or are you about to? I think F-1 overstays are forgiven when petitioning AOS based on marriage, but is "out of status" the same as "overstay"? I'm sure someone here will know more about this.

well i doubt there will be a problem, well school probably thinks you did something fradulent, by forging medical papers, but they just put you out of status by reporting you to USCIS and saying `she's not attending`

i don't think they gonna go outta their ways to report that action of yours, although it wouldn't look good on our records, i doubt they would do that

well right now you're out of status, but you're talking about interview so i believe you're already filed everything and waiting for the interview, so i doubt IO will deny your 485 for this, so don't worry about it

another former F-1 student here - I'm confused about the medical note that you are talking about - but if your worries are about being out of status then I can put you at ease. Congrats on your husband's citizenship approval!! With that you definitely can adjust your status from student to permanent resident.

I got married before my student visa expired but couldn't file for AOS right a way and long story short, the marriage turned bad and abusive from my wife's end and we got divorced several years later. During my separation I got to know my now wife and we filed for AOS last October. At the interview they did ask me if I have the original divorce papers from my first wife and a yes/no question if anything was ever filed by me or my ex-wife with USCIS regarding adjustment of status for me.

No other questions were asked regarding the visa I entered the US with.

p.s. if that woman approached you regarding an immigration medical exam that you will guaranteed pass, I wouldn't go for it, for the price she said you can definitely find a licensed, honest civil surgeon who can examine you and fill out your paperwork.

The way I'm reading it, she attempted to get a doctor's note for medical absence (to justify being out of school) so the school would not report her in SEVIS. She paid someone $200 for a fraudulent note and the school (as they should) double checked with doctor that she really had a medical reason and could not attend the school and upon discovering the truth they reported her in SEVIS.

You must always tell the truth. Lying or misrepresentation can get you a PERMANENT ban from the US. I don't think you will face a criminal charge for getting a forged doctor note, but they might question your moral character.
