A while ago someone told me that I had to send my birth certificate as well as my fiance's birth certificate with a translation for the I-129F form. I can't find anything that says that I need to send a copy of his birth certificate so can someone tell me if I am just not seeing it somewhere or if I really don't need to? I already have copies of it and have also gotten it translated from French into English but I keep going through the checklist and don't see it so should I not send his and just send mine? Thank you very much!!! If someone could please let me know asap as I am trying to get this packet sent out tomorrow! Also, for those who have sent things to the USCIS office- did you just send it through the post office or did you send it through Fed Ex or UPS? Thanks for your help.

no the only time your fiance will need the birth certificate is when he goes for his interview. As for posting your stuff that is entirely up to you, if you want to track your package then go for FedX or UPS.

Yes, fiance's birth certificate will be needed at the interview but not for I-129f submission. I sent mine USPS, I think it was priority mail with delivery confermation. They gave me tracking number and after 2 days I was able to see online when it was delivered. Less expensive than Fedex or UPS and very easy.

The birth certificate of the USC is required to proove US citizenship. The beneficiary birth certificate is not required at the petition stage with Service Center. IF they require one they will ask for it via an RFE (Request Further Evidence). The beneficiary birth certificate is required with the DS-156 Application for a visa at interview stage.

However it does no harm to include it as it MAY be beneficial with security name checks in as far as showing your identity and MAY assist in a 'False Hit' situation.

The USC's birth certificate is NOT required. What is required is proof of citizenship, and the birth certificate may be the easiest way of providing that proof in some cases. A passport also works (that's what we used), even if the USC got his/her citizenship via birth in the US. Depending on the facts of the case, a naturalization certificate, consular report of birth abroad, or other paperwork may provide proof of the USC's citizenship.

The Alien's birth certificate is not required at the petition stage, but if it omitted, there is a chance that it may be requested via an RFE, causing a delay in the process. If it is submitted and it is not in English, then an English translation must be supplied per the instructions found at this USCIS web page. If a non-English birth certificate is submitted without a translation, then it is extremely likely that an RFE will be issued to request the translation, even if the birth certificate itself wouldn't have been necessary to process the petition.

So the choices are:

Submit no alien's birth certificate -- possible RFE requesting it with translation

Submit alien's foreign language birth certificate without translation -- virtually certain RFE requesting translation

Submit alien's birth certificate with translation -- virtually no chance of RFE on birth certificate issue

In any of these cases, the alien's birth certificate will be requested at the interview. Consulate rules for translations will apply at the interview. Consulates vary, but most of them won't require translations for documents in English or in the native language of the country where the consulate is located.

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

My Fiancé' ( The beneficiary) does NOT need my(the petitioners) original birth cert?

Or

Yes they do need an original birth certificate from the US citizen along with theirs?

I think I need to re-clarify here.

Does my Pilipina Fiance need my original birth certificate with her for the interview. When I send her the NOA2 package with the K1 application and all documents do I include my original birth cert and mail it to the Philippines for her to use in the interview.

OR

Does she simply need her original birth cert from the Philippines which we have already? ("original" looks like a copy but its on green paper and looks official and is from NBI so I am assume that is there version of original)

She will need your original birth certificate AND her original birth certificate for the interview.

To prepare for the interview, your fiancée can have a look at the Philippines's portal on VJ, I am sure the list of what she should bring and prepare must be on there blush.gif
