Hello,

we are about to send in the perm res app for my wifes son but the 90 day k2 visa expired on Jan 25. Will this be a problem? Should we consider another route?

The K2 visa expired the day he entered the US. The I-94 is what expires 90 days later.

Generally, yes, he can still apply. As long as your wife applied first or at the same time, he has not become inadmissible (got into trouble with the law, etc.), and he has not passed his 21st birthday.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
