I arrived with a k1 visa and we got married within 90 days of my arrival. Now we are applying for AOS. What I don't understand is how will my name legally change, so I will be able to use my husband's name. I sent all the documents and used my single family name to apply.How will the papers that I receive from USCIS look like? with my married name or single one? thanks

If I am not mistaken it will depend on what you wrote on the marriage certificate? or on the forms when you sent them out. once you are married you can change your name but have all the paperwork in that name..

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

You will have to use your husband's last name on all the forms that you will send.

AOS Process

2010-12-30------------Sent I-485, I-765, & I-131

2011-01-10------------Received NOA1 for AOS, EAD, & AP

I went at the SSA with my marriage certificate and the application form (stating on what name I want my SSN) and that was it. In the meantime I applied for AOS with my married name (I also provided the marriage certificate) and that was the change of name process too. I got both my SSN and GC on my new name.

November 19, 2010 - February 24, 2011 APPROVED!!!
November 19, 2010: AOS, EAD & AP applications mailed
December 20, 2010: Biometrics (day 31)
January 18, 2011: case transfered to CSC (day 60)
February 10, 2011: EAD & AP approved! (day 83)
February 24, 2011: GC production ordered! (day 96)

Removing conditions: 5 months and 30 days!
December 6, 2012: package mailed
December 10, 2012: NOA 1 (day 4)

June, 5, 2013: APPROVED!!!

June, 10 2013: 10 yr GC received

You've stated that you've already sent the forms with your maiden name (single name) on them.. so your GC will arrive in your maiden name. If you wanted to change your name to your husbands you would have written your married name on the forms.

Hopefully you have an interview and can change your name then, otherwise you'll need to wait for Removal of Conditions (2 years time) or page $450 for a replacement card

**Edit - you should keep your SSN and everything else in your maiden name because otherwise they won't match your GC (for work the SSN needs to match GC same with drivers licence). When you change your GC name then you can change the SSN etc to married.

Since you said u already filed the papers in your maiden name,then your GC should have your maiden name.If u wanted your husbands last name, u should have started using his name in all the forms you sent out.
