Hi,

I just got accepted into my dream school, and although Tim and I plan to have my AOS expedited coz of deployment, I am not gonna put all my eggs on that basket. So school starts September but enrollment is August, and I am corresponding with the international student liason of the school right now, and she is not very familiar with the k1 to AOS process. Does anyone have any links or any info I can show her that would show that k1 visa holders are entitled to study, or just prove that we are not illegal or anything while we wait for the green card? Not that the school won't let me enroll, I just want to lessen the confusion and make things clearer somewhat.

It's a private school so I would have to pay full tuition regardless, so I am not worried about in-state/out-of-state rates since its the same for everyone whether they are intl students or not. :( I have a financial grant that will help me with tuition a little bit.

Also, I know this is completely unrelated but how soon after filing taxes can we request for a transcript? Right away? We filed about two weeks ago. And since we don't have a fax machine, could we just go to a UPS and then call up IRS and have them fax it there while we wait for it?

You tell your school that you entered the US lawfully with a K-1 and thereafter submitted the AOS paperwork to become a Lawful Permanent Resident, a Green Card holder. You are legally in the US and that's all what matters here, aside from the fact that the school could care less as long as you hand over the mulah.

Thanks for the info! Will get the transcript this week! And will also tell the school that.. :) I think she is confusing me with a tourist who got married and is now on AOS.

One more unrelated question (but still in my thread), would it matter if we only send out the 2010 transcripts? we don't have any for the previous years because he was a student

that's fine BUT if he didn't file his taxes you should include a letter stating why he didn't need to file his taxes.

do you file taxes when you're a student?

If you are working while going to school, yes. I filed taxes every year while I was a student because I almost always got a refund.

If he wasn't working, just include a letter that says he was a student during that time period and didn't work, therefore didn't file taxes.

You should! there's this awesome education credit that you might be eligible for :) Tony files ('cause he works) and we do it married jointly so my info (or lack thereof) is on there so you should try that.

For my stepson (17) being a K-2. I took in his passport plus the I-797 showing we were in the process of Adjusting Status. Your diffently right about international student liason they are not familiar with any other type visa other then student visa's.
