Hi everybody, I am new here. It is my first post. my US citizen spouse serves in USA military ( National Guard). He will be deployed in a less than 4 mounts later to Afghanistan.on August he filed I-130 form for me. but due to transferring my case from California Service Center to Texas Service Center we didn't hear anything about approval of my case so far ( we have a REF on 23 January). on the other hand I have not seen my husband for a long time. Can i apply for non immigration visa to see my spouse before his deployment? I only want to see him before his deployment and after that I will be come back and I will be stay outside of USA to complete my immigration processing. since we have not seen each other for long time, my husband and me are in bad emotional condition. I need to see him only one time before his deployment. how can I see my love before his deployment? he wants but cant to come here to see me. I wish I will be here before his deployment.

I dont know if i had any chance to get non immigration visa :(

I applied for a tourist visa while my I-130 was still pending and I was issued one. My husband is in the military too. We are already living together here in germany, i came here through command sponsorship. The military was sending him to school to the US and at that time I was pregnant and we also have a 3 yrs old. I can't drive bcoz of my eyes so I have no way of getting around if my husband goes to the US. So i applied for a tourist visa to be with my sister in the US and visit my husband's family. I got approved but unfortunately, the way they sent the passport back was just through regular mail, so it got lost. End result, husband wasn't able to go to MPI school and has to wait till all this visa issue is resolved.

But anyways, my point is, you can get one if you have a valid reason and that they are certain that you intend to leave.

I would call the service center handling your packet and ask for your packet be expedited by to military service requirements. Or have your Husband contact his congressman to help a serviceman expedite the approval process. I don't think anyone in VJ would be bothered if your application was expedited due to your husband's service to our country

Based on what you are saying you might be able for expedited processing. Your husband needs to talk to his commanding officer and maybe he is nice enough to wirte a letter to USCIS asking for an expedite for your case because your husband needs to concentrate on work and be fit and ready to deploy. We got approved because of this very reason.

Oh and you can most certainly visit the USA. But be prepared to answer the questions of the person at the point of entry. They will probably ask you if you intend to stay (no, I'm only visiting my husband because... and we already have started the visa application). A few "binding ties" also couldn't hurt. Like a work contract from your current job or a rental agreement for your appartment/house.

thank you msd for your response.

my husband spoke with his commanding officer, he said that after i 130 approval we can expedite my case. recently we post some evidence that USCIS requested and so far don't hear any thing about approval. I don't have any job here at this time but I certainly want to come back. because my father is sick. he has stage 4 cancer. I want to come back home after my husband's deployment. my father is not in good condition. if i can get non immigration visa I can see my husband before his leaving and come back home after that to be beside my father.

In that case you might have to provide some evidence when you apply for the tourist visa.

Although I don't know the procedures since I'm from a country that does the ESTA process so we don't need one.
