submitted I-130 in August STILL WAITING for K3!

I began the visa application process in August. I received my NOA1 for my I129F on Oct 20!! I am STILL WAITING FOR MY NOA2.... IT HAS BEEN 5 months!! Is anyone else in this situation? My wife is considering applying for a tourist visa and coming over to visit me...

I found out from a lawyer that it may have been much easier to have her come over on a tourist visa in the first place then do an adjustment of status. IS THIS WHAT YOU HAVE HEARD FROM OTHER LAWYERS???? Trustworthy lawyers/information is hard to come by, but it seems like i wasted a lot of time and waiting by doing things the RIGHT WAY! I feel really bad for my wife being all the way across the world.. Any suggestions on what to do from here on out? Our patience is wearing thin and we really want to see each other.

It seems like the USCIS is sooo slow during the winter months (does the winter holidays have anything to do with this?).

She would not need a tourist visa as from NZ she can come over on a VWP like and Aussie vaild for 3 months but you could be so close now as it is what nearly 5 months but hey she could come over a for a few weeks just make sure her return date is flexible. You did everything the legal way and that's the way to do it. Bloody lawyers some of them seem a joke. SO he is saying she could have some over here on a VWP (NOT) and apply for AOS (NOT) would not be approved as they are cracking down on AOS from VWP as she would not get a tourist visa to come here we don't need them from our countries. Keep the faith and hopefully she can get over before the airfares rise for summer and have a visit while you are waiting. Have you made any calls as to what's happening with your case?

The I129F actually slows the petition down. Your I-130 was likely pulled from its place in line and put at the back of the pack once it was married up with the I-130. Sorry, but this is what happened. When we petitioned, I-129Fs were approved 6-8 weeks AFTER those with a stand-alone I-130.

So you're in for a bit more of a wait.

No, you cannot come over on a tourist visa with intentions of immigrating. This is visa fraud and unless she intends to tell the CBP when asked 'how long are you staying' "I don't intend on leaving, I intend on adjusting status from a tourist to a permenant resident based on marriage' then she will get turned around on the next flight. To do anything else, to imply visiting when that is not the case, can be a misrepresentation charge

PS- on and no more K-3. It is a dead visa and will be closed by NVC.

Timeline

I would call them now and ask what's going on with your case. They will tell you it's only been 5 months and call back at 6 months. At that time you call them then I am sure you will get something going. I waited 6 months and 1 day. I then got and RFE 3 weeks later.
