Skipping the I-751

I am in the process of filling out the I-751...

However, we have friends that were married almost at the same time. In fact, my wife met her at when she was getting the fiancée interview in Thailand. They have just turned in the paperwork to get her first green card and this is after waiting 2 years. During the interview process for this first green card, she was told that she would get the 10 year card and not the 2 year card! I understand they have already been here for 2 years but it seems strange they can jump ahead in the process.

I was just curious if this is a common practice. We have to fill out the extra forms.. and pay the additional $590. Our friends are skipping this step since they were too slow!

Perhaps it is wrong to do the right thing?

K-1 Process

NOA1

01/04/2008- Received date for NOA1 Receipt for I129F

NOA2

05/09/2008- Email that Approval Notice was sent for I129F

5/16/2008 - Received I-797C Notice of Action 2 Approved the petition and have sent the original visa petition to the Department of State National Visa Center (NVC). The NVC will within two to four weeks:

NOA3

6/2/2008 - Fiancee Received Packet 3

6/9/2008 - Fiancee sent packet 3 to Embassy

6/16/2008 - Fiancee finished Medical and police report. Police report to be mailed to her in 2 weeks.

6/30/2008 - Have police report

7/29/2008 - INTERVIEW DATE! SUCCESS!

7/31/2008 - Picked up Visa 2 days later from Embassy

8/17/08 - Arrive to USA! (Yes, we booked prior to the interview)

9/15/08 -- Social Security Card (Had to argue about card with K-1)

11/13/08 -- MARRIAGE!

11/15/08 -- File for AOS

2/2/09 --- Received Advance Parole

3/15/09 -- Received Work Card

4/3/09 -- Trip to Thailand... Married Again

5/11/09 -- Interview and approval of AOS (ship card in 3 weeks!)

If the marriage was more than two years old when the greencard is issued then a 10 yr card will be received... if your marriage was NOT more than two years old when the first card is issued then you will get the two year conditional card and the I-751 will need to be used. Their is no "skipping" the I-751 if you received a 2 yr card

Not to mention she hasn't been able to drive, work or a lot of other things in the two years she's been here and out of status.
