We are now married and are filling out the I485 for my kids. The question I have is what is now their current USCIS status???? I just filled in the box "married to US citizen". Does anyone know what my kids status would be??? They are no longer a KS so I'm not sure what to say there. :unsure:

If the kids are not still in K2 status, and I-485 has not yet been submitted by them, then their status must be 'out of status'.

But why are they no longer in K2 status?

And that is maybe my question.......maybe they are still a K2 status. I am assuming that now I am married I am no longer a K1 (fiance) but I didn't know what status they would be now.

Mich,

You entered the USA as a K1, and the kids as K2s, and you were all given 90 days to be here.

There are some issues over which there are debates as to whether or not the K1 status ends with marriage, but for this purpose (submitting I-485) my sense is that answering the question with 'K1', or 'K2' as the case may be, is telling them what they want to know.
