While you wait for this rfe , I would recommend that you start putting together the passport photos you sent earlier of yourself and your beneficiary (seeing that this may have been misplaced). you may also ensure that you put together birth certificate and the marriage certificate (in long form) as well as additional proof of your marriage since any of this may have resulted in your RFE.

Can they be new passport photos? Not sure if I have any left of the ones I sent in.

Update on my case... sent in the opt in email on the 7th. Got a confirmation back yesterday the 11th. I can now do everything electronically via email! Also paid my AOS fee... is still pending.

If the RFE was for the photo then you may need to take new ones. However make sure when you respond to the RFE that you make a duplicate of your response. Also for your NVC process always ensure that you keep two copies of the whatever you send in. Dont worry you will be with your spouse sooner than you think.

Still haven't received my RFE that USCIS says they sent out on 6/24. I called today since they couldn't do anything about it until the 15 day mark. The gentleman said that he would send a service request out and I should hear from them by 7/26.(is there anyway to follow this request?) I asked how long I had to respond to the RFE and he said 30 days. I asked him how that was going to be possible since it had already been 17 (sat was the 15 day mark) and I still have to wait to receive the new one in the mail. Plus have time to get together what ever they are requesting.

USCIS said that if I don't send in what they need with in the 30 days my application would be denied.

Has anyone else ever ran into this problem? Is there anything I can do about the time frame?

Update! I just received a text message and email stating that on 7/13 an RFE was sent out.

Wonder why I never got an email or text when the original RFE was sent out on 6/24, which is the one I never received?

Oh well.....very very happy to see some sort of progress.

That's good news. Maybe since it is dated 07/13 the follow up time will be adjusted and not be based off that initial 06/24 date?

Well I finally received my RFE in the mail today. They did update the date to 7/13/11 and gave me until Oct to get it back to them.

They are wanting a signed copy, by the judge,of the divorce decree for my husband. The one I sent in had the stamp on it but I guess that wasn't good enough.

Does anyone know if this is something he can get straight from the court and maybe how long it will take to get it from them.

I am hoping he can get it before he comes to visit on 7/26 but he doesn't get off his rig until this Friday which would only give him Monday to get it.

I am happy however that I know now what they are wanting from me.

I telephoned the County Court where my divorce was done and paid them over the phone for two certified copies of the decree - £5 each. They arrived in a few days. I don't know if I could have gone there and picked them up in person.

That is a wonderful idea! I have emailed him the # he needs to call and hopefully the paperwork will be there when he gets home.

Tell me, does the certified copy have more than just the red county stamp on it? That is what I originally sent in.

No, I have just checked it and the red stamp is all there is to show that it is an original. It is a single sheet and there is no place for a signature. I remember that my husband's decree from Georgia is about 9 pages with an embossed seal and signature on the final page. Good luck and I will be interested to hear how you get on with it. Have you called USCIS and spoke with a tier 2 rep to check the status of your case? I would have never even known about my RFE if I hadn't called as the website never updated.
