Now that most of us r affected by Retrogression, most of ours cases are completed at NVC and all must have submitted IT returns from Petitioners for 2009, 2008 & 2007 years. But now that all our interviews will be scheduled after April '2011, Consular Officer will ask for 2010 Returns from us coz they require latest Tax Returns. So we all must be prepared to ask our petitioners to file 2010 returns and send us before our Interview. They will not mention this on Appointment letter but we must be prepared to carry all documents with us during our Interview in order to avoid getting 221(G) letter from Consulate.

Most likely YES. If your interview is after April 15,then they will ask for 2010(the recent one). :thumbs:

Not exactly.......we're filing for an extension of our taxes since our interview date should be so close to April. My wife will get her SSN and be in the states shortly thereafter. This avoids all the headache of filing this, waiting there, and praying someone in Austin Texas doesn't have mindfog when they process our taxes and ITIN. Our accountant HIGHLY recommends this and I'll scan and email the form sent for the extension and our reasoning behind it. We're getting money back so Uncle Sam won't mind an interest free loan for a couple months made from us to him. Well worth the peace of mind.

Please investigate if this would be a valid strategy for yourselves.....as one glove doesn't fit all. Best of luck!!!! :thumbs:

hi guys,

My wifes application is at NVC and i paid the IV bill . Based on various inputs I am going to submit my 864 with the coversheet page. As i recently started earning regularly I wanted to include my `10 tax papers as proof of income. Going thru the taxes I realized that to claim the " married and filing together" I need a tax ID for her and hence need to file the W7 for her ITIN. However isnt ITIN is going to take a heck lot of time and also isnt it just for non-immigrant visa holders or does it apply to general spouse of US citizens? I know this is a tax question but I asked nevertheless. I am in a dilemma as filing married would help our case not to mention the greater refund, but filing single would get my 1040 filed sooner..

Any advice is appreciated..

If I'm not wrong, on the AOS it included an employment letter which contained our rate of pay. I also included my last 6 months paystubs. This had the year's total on it (December 31st paystub) and current ones till I sent it in. If you are self employed, you may need to consult a power greater than me. I'm not sure on that case. It's a tough calculation to try and guess how far you are to being able to bring your wife over. I'm not sure of the timeline of the consulates in India.

There was a quite extensive discussion of the proper ways to file in the CR1 IR1 forum. Married filing taxes It's long but helpful if you decide to file prior. My accountant said the route we're taking makes it very easy on all involved. Best of luck Swap!!

so you are filing an extension to-file taxes later (with your wifes ssn)as well as applying for the ITIN just in case?? did i get that right?

Your filed copy of the 2010 1040 should do along with the w2s and 1099's (or at least a copy of them) to show current income/proof that you will be above the poverty level. Hope this helps, sorry it took so long to get back with you.

I'm just doing an extension till August (one extension). She should be here by then and with SSN in hand. Our accountant said depending on the backup in Austin, it could take several months to get your return from the IRS and they're not the most user friendly service....letters only I believe.

I applied for ITIN for my wife, filed married jointly, though didn't receive refund yet but they have activated the ITIN in just one month. May be in two weeks I will get my tax return transcript

Hello, I just wanted to ask about tax return. I got arried in Turkey in October,2010. But when I filed income tax I didn't even realize I could put married since he's not here yet. So I put as "single". Do you think it might be a problem at his interview? Also, when you filed as "married" and did taxe jointly, did you had to include her income, or any kind of employment forms from her country? How exactly is that done? Please help, and is that to late for me to fix it, since I already received refund? thank you so much
