In the following topic http://www.visajourney.com/forums/topic/298620-i-864-question/ YuandDan had posted that one's chances of getting denied are high if I use my parents income for I-864A.

Why is this? I currently live with my parents, going to college and at the moment do not work(so $0.00 income).

I am listed as dependent on their taxes.

In that case the poster stated that the parents' income was lower than the requirement for a household of 2 and could be a problem for that person. So that set of circumstances may be different than your situation.

In the following topic http://www.visajourn...i-864-question/ YuandDan had posted that one's chances of getting denied are high if I use my parents income for I-864A.

Why is this? I currently live with my parents, going to college and at the moment do not work(so $0.00 income).

I am listed as dependent on their taxes.

Since you and your parents live at same address, your parents can file I-864A to combine the income with you. Since, you have zero income, parents' income need to meet entire poverty line of the household size, in this case.

I think there is a misconception about who's dependent in the most recent tax return to qualify for I-864A. "A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at the same residence as the sponsor;" So in your case, if you (sponsor) claim your parents as dependents in your most recent tax returns, your parents may be considered as the household member to file I-864A.

However, since you and parents are at same address, your parents can file I-864A.

Now the question is what is your household size? Probably here is the denial part happens.

1. Sponsor (you) will be always counted - 1

2. Intending Immigrant will always be counted - 1 (I think it is your spouse only in this case)

3. Household member who files I-864A - ???

If you combine only one parent's income, he/she will be part of your household size (Item# 3 count above will be 1) and he/she needs to produce his/her W-2/1099 etc. to clearly shows that this is his/her income.

If he/she can't do this, Item# 3 count will be 2, since both parents are involved now.

Assuming here there are NO other dependents etc.

Now check the poverty line against the household size to see if you guys meet the income guidelines.

Another catch is if the income is just above the border line, CO might question as well. In this case, add some liquid asset as well to make an healthy income level.

Good luck!

Loto
