RFE After 5 Months?

Hi Everyone,

I just received a RFE notfication from the USCIS. :( This is after they have been sitting on it for 5 months. I suppose this is the first time that they have reviewed my case. Does anyone have any experience of how long it typically takes after the USCIS receives the requested information to approve? Would my file go back to the end of the list or would they review it right away? I wonder what more information they need from me.....:wacko:

same with me here..just got RFE..let's put it on bright side..they looked on our case once we know what we need we should hurry and hopefully not more than april we will get the NOA2

That is correct. That is how much backlog they have in front of them.

Depends on the info requested. Usually about 2 weeks upon receipt.

Would my file go back to the end of the list or would they review it right away?

Usually right away once they finish with what they are presently working on.

I wonder what more information they need from me.....:wacko:

Looking at the complete copy of your entire peititon package that you made prior to sending it (you did do that, correct?) can you find the error oro omission you made?

same with me here..just got RFE..let's put it on bright side..they looked on our case once we know what we need we should hurry and hopefully not more than april we will get the NOA2

Wow. That's weird. We should touch base to see if they are asking for the same data.

I guess we know that California is on 9/28 today.....

Look at my signature. I received an RFE after 6 months so it happens. After you send the requested documents than it takes about 2 weeks for them to make a decision (approval, RFE or denial). Don't get scared, if you provide what they want then you will get approved in 2 weeks after you send it.

It stinks, but at least you know you're next in line!

April, 2009 - We met

May, 2009 - We wooed

June, 2010 - We got engaged, looking forward to a small August 2010 wedding

December 29, 2011 - call around for information about delay

January 5, 2011 - RFE notice (first online status update yet!)

January 10, 2011 - RFE Hardcopy

January 24, 2011 - NOA2 (at last!!)

February 3, 2011 - application sent from NVC to Montreal (aka. the Abyss?)

March 7, 2011 - Packet 3 sent to me

What is the RFE for? Can you send it in right away? I got one too, it was approved 3 weeks later. Then onto a very long wait at the nvc. This whole process sucks.

Your wait at NVC was due to your attorney, not NVC. grrrr

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Yes, We got a RFE also, but submitted the needed papers (and many worries...) and got NOA2 a few weeks after, really fast. Do not delay! Oh, my RFE came in about the 5 months too.

We submitted last September 24th and received RFE on March 1st. Five months and one week.

What's surprising to me is the RFE is asking for evidence of our last personal meeting when we already provided a mountain of evidence of exactly that.

She was sitting right next to me in our apartment in America as we put together the package of evidence. We included precisely the things it's asking for already--primary evidence of meeting in the last two years in the form of airline ticket stubs/receipts, passport page copies, et cetera.

I'm not really sure what more to submit. Resubmit the same stuff? Add in the ticket stubs from my trip to see her in December (if I still have them...) and photocopies of my passport from that trip? :crying:

RFE is not that bad, I know your thinking that it will delay your petition but at least now you know that they are working on your application. I also got a RFE on my 5th month. They asked for a copy of my passport so after sending the copy of my passport to USCIS i got approved in less than a week. But i think it depends on the RFE. I hope yours is not that complicated. Good luck!
