I-130 rejected

Ok... probably stupid question, but I'm hoping my instinct is wrong.

I just received the I-797 NOA on my I-130 submission. It was rejected because of "incomplete address" (I guess the standard Costa Rican address of "400 meters west and 250 East of the church in san antonio, escazu, san jose, costa rica" wasn't good enough for USCIS).

Two questions:

1.) What the hell address should I put?

2.) Can I file the I-129F now? I can't find the answer anywhere online. It just says that when you file the I-129, you need to include your I-797... it doesn't say the 797 needs to have good news on it!

Are you Married..? How are you trying to Switch to the Fiancée Visa. What address should you put? I think you should ask the applicant/beneficiary his/her address (proper).

Sorry, to file an I-129F petition, requires you have a NOA-1, receipt notice, on the I-130.

You don't have that.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Darnell.. The I129/I130 can be filed together.. what is the purpose/benefit if the I129 will be closed once it gets to the NVC?

Give the address of the Church, or if a street and number is not available, MAKE ONE UP! I'm sure as long as it gets to her town, someone will know her or her family.

NATURALIZATION

02/25/2014 - Eligibility date.

03/03/2014 - N-400 package mailed.

03/11/2014 - Check cashed.

03/14/2014 - NOA received.

04/09/2014 - Biometrics.

04/28/2014 - In-Line for Interview - 6 hours later Interview Scheduled!!

05/02/2014 - Interview Letter received. (Mailed on 29 April)

05/26/2014 - 3 year anniversary.

06/02/2014 - Interview. PASSED!

09/11/2014 - Oath Ceremony.

09/16/2014 - Updated driver licence and registered to vote.

10/08/2014 - Updated Social Security

10/14/2014 - Applied for U.S. Passport

10/27/2014 - U.S. Passport arrived in mail (13 days - DID NOT expedite)

10/30/2014 - Naturalization Certificate arrived in mail (was not folded)

MY IMMIGRATION JOURNEY IS OFFICIALLY FINISHED!!

Although it 'can be'

normally it's not.

Normally the I-129F is sent in after the NOA-1, form I-797-C, Receipt Notice is received by the petitioner.

now, as to 'what is the purpose/benefit of the I-129F' ? If you read my posts in the K-3 forum, you'll find the answer.

US Citizens could never apply for a K3 visa. Foreigners apply for visas. US Citizens "file petitions". Please don't interchange the terms "application" or "apply" and "petition". It causes lots of confusion.

The OP wasn't trying to switch visas. He just didn't know there is no longer any benefit to filing an I-129F for a spouse.

Facts are cheap...knowing how to use them is precious...

Frankly, you should not have gotten rejected for that, if it was in the correct place on the I-130 or referred to a separate sheet etc. Now that it's happened, I would enter 400 meters west and 250 East of the NAME OF church in san antonio, escazu, san jose, costa rica", or if the Church has a more complete address, use, "400 meters west and 250 East of THE ADDRESS OF THE CHURCH...." Whatever the best available address is, send an explanation that you have provided the best available address. Some people don't know that many US addresses are similar. I have a customer with an address like, HWY 287, 2 miles West of City, State ZIP. Educate them this time and forget the K3. Not viable anymore and will slow down your I-130 approval.
