Ok so my now husband came here on a K1 visa back in August '10. I was with him in his home country for 6 months and returned with him to the States. We got screwed out of a place to live by people who were supposed to be helping us readjust, so we had to spend all of our money on security deposits and furnishings, etc. We weren't able to AOS right away.

Fast forward 6 months, I'm working, making good money, he stays at home with our one year old. We're in a position now to afford AOS, but at this point, I'm thinking to just wait 18 months to file, so he can get a 10 year card. He's a stay at home Dad, we don't need income from him at this time, and he only leaves the house to visit my family and grocery shop, maybe go out to dinner once in a while. So I'm not worried about him getting picked up.

My question is, what kind of issues could arise from us waiting 2 years to file AOS? Will they give us a hard time? We have all the paper to back us up- lease, bank account, insurance policy, and utilities shared. Is there anything else I can do now to make a future interview go smoother? What should I anticipate?

If there were financial reasons that you could not afford to file for AOS I think they would let it slide however since you are working making enough money I think they could give you a hard time since they would see there was money to file.

Also lets say you did wait to file and then 2 years down the road(if green card approved) your husband is applying for jobs and employers are looking at job references and will see a large gap from the time he arrived in the USA and did not work. This could be a negative. When my husband started interviewing for jobs this was always brought up and he was only here 6 months. Thankfully he got a job and can use that as his stepping stone.

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

04/2010 - Married

AOS Timeline

4/19/2010-Sent to Chicago Lockbox

4/26/2010-Received texts and emails 7th day

4/30/2010-Received NOA's(Hardcopies) 11th day

5/3/2010-Received ASC appointment notice(mailed 4/29/2010)14th day

5/7/2010-Walk-in Biometrics done(2 weeks earlier)18th day

5/13/2010-Case transferred to CSC

6/2/2010- Case received/resumed at CSC

6/18,6/22,6/23 AOS touches

6/28/2010- EAD production and touch on AP

6/29/2010-AOS APPROVED

7/2/2010- 2nd update on EAD production and touched on AP....

7/6/2010- Received "Welcome Letter" and AP document

7/12/2010-Received GREEN CARD and EAD

I find it interesting how people ask for "advice" and "opinions" then get their panties in a wad when people don't give them answer they want or expect. Why bother asking if you've already made up your mind?

If you READ the original post, I kinda made it clear that I'd already made up my mind. My question was, what kind of response could I get from USCIS about it. I never asked if I should or shouldn't do it.

I have read the OP's subsequent posts and say "cool, do you.." However, for the other posters here, I want to thank you for re-affirming the emotional experiences of other spouses who have been in the OP's husband's position. This community is sincerely a treasure for those who have few (including spouses) who truly empathize with what immigrants experience.

Thanks and keep sharing.

For the OP: I realize you are uptight (possibly understandably so)about seeming kinda unreasonable, but please be compassionate in how you approach the member from whom you solicit advice.

Yes, thanks to all of you for projecting emotions on to my husband whom none of you (excepting "luv my fiance") know. I'm not uptight. I just get sick of people asking simple straightforward questions on here and then getting a barrage of unsolicited "life advice". I only wanted to know what to expect from USCIS. Thanks to Jim for addressing my question.
