Affidavit of Relationship?

Hello, I do not know if this question has been addressed in the forum before, but I do apologize for being redundant if it has. I have been carefully gathering my documentation for my K1 application and when I went to my Immigration Attorney to present it, they told me I will need some Affidavits of a Relationship. I did not find this requirement in the list of documentation from this website. OK I can get several of these so called Affidavits of Relationship completed by friends and family, but the real kicker is that the attorney is saying that the person who completes the Affidavit of Relationship will have to provide a Birth Certificate or a Passport to prove US Citizenship. This is ridiculous. This will take WEEKS to get from these people and not to mention that some may not want to provide this Affidavit if they have to go to the trouble of giving a Birth Certificate or copy of their Passport to some unknown Government Office for my benefit. Can anyone tell me about this bunch of malarky?

It's possible, your attorney sees and actual need in your case for such affidavits. Perhaps there are some red flags you haven't mentioned. Otherwise, yes, it's "malarky". No such affidavits are needed or even advised for a K1 visa coming from Ukraine. They are a strange request (the birth certificate or passport part) even for a spouse visa through the most difficult of consulates. Kiev is one of the easiest. You hired the attorney. If you don't like the service, you have the option of firing them or simply asking them to do without these superfluous affidavits.

What a load of codswallop this is. Why do you need a lawyer, you can do this quite easy on your own. All you need to do is follow the gudlines for the 129f petition on here or USCIS site. Follow them to the letter and you will be fine. If you looik up Gary and Alla on here from Ukraine he will advise you better as well He is very knowledgeable about Ukraine. But no you do not need affadavits for 129f

I agree, it all sounds like something where the attorney may be looking for birth certificates to help others get green cards, or get immigration papers. Something just does not jive with his request. I would get rid of him, and report him to the local state attorney office for ethics at the very least.

If you get and RFE request, then deal with the RFE. However, most RFE's from my research are proof of meeting, or proof on continuing on-going relationship. (chats, emails, talks, pictures, expenses. ) Letters from other sources and birth certificates or passports from others makes absolutely no sense whatsoever. I have been researching i-129f since almost 2 years and never heard of it. Also, my contact at anastasia thinks this is just downright hilarious. they have an embassy rep at their trips, and he advised following the i-129F instructions. If you want to prove your relationship this way, it has to be people who accompanied you on the trip, or people you met there on the trip including the extended family. Your local family can attest to a relationship, but can only attest to what they hear from you unless they correspond with the fiance as well.

No, here on VJ we call this the Letter of Intent to Marry. Read the Guides and follow the Example Forms. Use the Example Forms but you need one with original signature from both the Petitioner and the Beneficiary.

Get your money back. None of that is required for a petition.

You need, for the petition

1. Prof you are a citizen (birth certificate or passport)

2. Proof you are both "free to marry" which means a divorce certificate if you were ever married, nothing if you were never married

3. Proof you have met within th epast two years

4. Signed letters of intent to marry (use the VJ sample letter, works perfectly)

5, Passport photos

6. Signed forms and a check for the fee.

For what reason do you this other stuff? Something we don't know?

Unless somebody is intimately acquainted with you, your capabilities and aptitudes as well as all about your case and relationships, they are not qualified form a meaningful opinion about whether YOU need professional assistance in ANY matter, much less an immigration matter. Most of us have done it ourselves but it's not for everybody.

Most of us have done it ourselves but it's not for everybody.

I want to thank everyone so very much for your kind, informative and quick answers with information for me. It is surely appreciated.

Before I started this process I visited this forum and asked questions during the summer (2010) and also some other forums. Many people advised doing this myself. I believe I am fully capable of doing it; however given that this has the potential to be a long tedious process that is fraught with peril for the least little overlooked items, I thought it best to engage a professional immigration attorney with outstanding credentials and recommendations. Not to mention that his legal assistant is also from Ukraine and speaks Russian and Ukrainian.

I would rather not spend the money of course, but in this endeavor I would rather be over prepared and over "gunned" should any problems arise that might need smoothing out and speeding up the resolution to a successful happy ending.
