How to prepare the Adjustment Status Package

I'm almost ready with the package! But I have a couple of questions I'm doing everything myself, I got married January 14 2011, I came with the waiver program and over stayed..

When i have everything ready how do i put everything together? PLEASE HELP! is this link http://www.visajourney.com/content/i130guide2 completely accurate? I don't see the affidavits? Where do i put them? SOS.

01/14/2011 - Married in Salt Lake City

03/07/2011 - AOS Package Sent (I-130, I-485, I-765)

03/08/2011 - (Day 01) - AOs Package Delivered

03/20/2011 - (Day 12) - NOA1 received via SMS & Email

03/23/2011 - (Day 15) - Checks cashed $1490, all Is Touched

03/23/2011 - (Day 15) - NOA1 hard copies received via mail

03/30/2011 - (Day 18) -Biometric Appointment received (for I-765 and I-485, Original Date: 4/19/11)

04/04/2011 - (Day 23) - Walk-in Biometric Successful (for I-765 and I-485)

14/04/2011 - (Day 33) - Interview Letter arrived Date May 23 At 2pm.

14/05/2011 - (Day 66) - EAD ordered it said it was on May 11 now it says on the 16 weird.

19/05/2011 - (Day 71) - EAD Receieved in the mail

19/05/2011 - (Day 71) - Applied for Social Security number

23/05/2011 - (Day 74) - Interview day - APPROVED!!!!!!!

You are not adjusting from a family based visa. You have posted in the wrong section, you are adjusting from tourist/VWP.

Depending on where you live, adjusting from a VWP with an overstay, may not be possible. Good luck with your Journey.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

It is family based, My wife is a US citizen and I talk to a lawyer and told me i can adjust in family base that's the only way to adjust from VWP.

Did u do your package yourself?

You are not adjusting from a family based visa. You have posted in the wrong section, you are adjusting from tourist/VWP.

Depending on where you live, adjusting from a VWP with an overstay, may not be possible. Good luck with your Journey.

Yeah thats good. I did it myself too. Hubby just signed what he needed to sign.. And its all good! Just make sure you have a clear copy of your i94 front and back and the visa too showing the admission date. I got an RFE for that. LOL And don't forget the cover letter, to make sure everything is in there!

You're applying for I-485 right? or not. LOL

You're applying for I-485 right? or not. LOL

The person is not applying for the 485 they are applying for the whole entire package with I-130 and beyond. They may not be ok because VWP overstays are not being processed in some places anymore and being automatically denied and sent to removal proceedings. It is a TOTALLY different process.

Excuse me that was EXCEPTIONALLY rude. You are NOT filing JUST the I-485. You are also filing the I-130 which is a COMPLETELY different process to the one done by people in THIS forum which is people AOSing from K visas.

You are running the risk of immediate denial because you are AOSing from an expired VWP. It depends on where you are filing from whether you will be put on indefinite hold or immediate denial and deportation with NO chance of appeal.

I am reporting this thread to be moved. Your personal attack at Inky is a violation of VJ TOS and was completely uncalled for and inappropriate.

Repost. Personal attacks are a violation of TOS, and one personal attack and post quoting it removed. Further violations will result in administrative action.

Hey there and welcome to the board.

Don't panic! There are a few of us who are about to file our AOS packets. I am sending mine in on Monday and it is a AOS packet which consists of the I-130, I-1485 and the I-765. I came on the VWP in 1998.

Depending on where you live, you could have issues as relates to having your petition adjusted successfully. Can I ask you which state you live in. Depending on which state you live in you may be headed for either (a)Instant denial, (b) Application being placed on hold or © Approval which is always discretionary.

I live in NY State which is a state that is currently approving VWP adjustments without any real problem.

If you live in NJ state then a case such as ours would be placed on hold.

If we lived in San Diego, California then we would not file. Our case will be denied.

So that is the most important question for you. You have already overstayed so the situation is trickier.

I will post some links of another about to filer which will give you more information about how to put the packet together.
