This topic has been talked about quite a bit, but I really wanted to get a specific answer for my situation. My fiance is here studying english on an F-1 visa (to be honest we were engaged before she came, but we "broke it off" a while before her interview so she could technically be honest if they asked her direct questions and whatnot...silly I know, but we re-initiated our relationship when she arrived). She's been here a few months now and we've been planning to marry. From what I've read, it would seem that if we do get married I can just apply for an AOS and things should go pretty smoothly from there? What kind of snags might we hit? What kind of precautions should we take? Could she be sent home after we're married even if I apply for an AOS? Any information would be helpful..THANKS!

Start by going through the guides on this site for concurrent filing of form I-130 and I-486 - and also look up those forms and their instructions on the USCIS site. You will be doing AOS from F1 to permanent resident. Once you do get married, keep in mind she should not leave the U.S. until you have filed your AOS paperwork AND gotten the AP (advance parole) document, which gives her permission to leave and re-enter while her green card petition is being reviewed. Also look at the forum "Adjustment of status from work, student, & tourist visas".

I'm an F-1, married my USC husband few weeks ago, and just mailed my AOS package about an hour ago :)

03/04/2011 - Day 1 - AOS -package signed for at USCIS

03/09/2011 - Day 6 - E-mail notification received for all petitions

03/10/2011 - Day 7 - Checks cashed

03/11/2011 - Day 8 - NOA 1 received for all 4 forms

03/21/2011 - Day 18 - Biometrics letter received, biometrics scheduled for 04/14/2011

03/31/2011 - Day 28 - Successful walk-in biometrics done

05/12/2011 - Day 70 - EAD Arrived, issued on 05/02

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

12/14/2010: Mailed AOS Packed to Lockbox
12/23/2010: USCIS Receipt notice for I-485/I-130/I-765/I-131
01/05/2011: Successful biometrics walkin at Charleston WV office!
03/04/2011: EAD and AP combo card in hand.
04/21/2011: AOS Interview at Norfolk local office. APPROVED & Card production ordered!
04/25/2011: Welcome to the US letter received in mail.
05/02/2011: Green Card arrives in mail!

That is fraud so just you know, you never really broke-off but just to tell the CO and POE you broke-off with your fiance and as soon as she got in the country you were back with him and reengaged.

I agree, you can lie to yourself and say you broke it off but you obviously didn't. You only said that so you wouldn't feel guilty when she lied to the CO.

Snags?!?!? If caught it is a misrep charge.

How long has she been in the US? What is her authorized stay in the US?

USCIS monitors this site and has record of this post. they have already tracked your IP address and know your name. you have been red flagged and will be denied when you apply, unless you do it the right way.

let her finish the schooling. send her back home before you apply. doesn't make any difference whether you marry her now or later, but don't try to adjust from F1 to AOS in a fraudulent manner.
