My fiancee arrived in the US on December 8, 2010. We were married yesterday March 1, 2011 within the 90 day period. We mailed the AOS application today showing her name as we would like it to be taking my last name and using her previous surname as her new middle name. We live in Ohio where I do not believe an automatic name change takes place upon marriage. My first question is "what is her name now legally?" We have not applied for a social security card yet. As I understand it with less than a week remaining on the I-94 it would be useless to apply now. Am I correct in saying we need to wait for the EAD and then apply for the social security card in her married name? Thanks !

If EAD and / or Green-card show married name, then this will be fine by SSA when you apply.

The photo identification from the government showing the married name is what is required. They would not allow us to change it without one of those and we tried several times.. They told us when we filed for her SSN that all we needed was the document from NBC showing the name and when we showed up with NOA 1 from AOS they laughed at us and said come back when you have a green card...

My first question is "what is her name now legally?"

As far as SSA is concerned, her legal name will be the name on her immigration document.

A foreign-born person’s legal name is the name shown on his or her immigration document (includes hyphens and apostrophes).

a. Name on immigration document and other evidence for an SSN are different

When the name shown on the immigration document differs from the name shown on other evidence submitted for an SSN, process the SSN in the name on the immigration document as long as the name can be derived from the other evidence (e.g., foreign passport).

If the required documents show clearly different names, do not accept the evidence to process the SSN application. In these situations, the applicant must submit SSN evidence showing the same name or submit evidence of a name change after the immigration document was issued.

I'm hoping you're right. We are in no hurry and will wait for the EAD but as another poster pointed out her EAD will have her married name but passport and visa will have her previous name and so there will be a conflict.

Philippine passport can either be mailed or brought in person to the Philippine Consulate in the USA for annotation (new name due to marriage).

What is the expiration on her I-94?
