Do not give up I suggest find a good lawyer and ask for advice, and your letter and long distance call will also be a great proof that ur intentions are clean so save those up

Thank you!!! Yes, I do believe that in this case a lawyer would be best. At least for advice... Plus I've heard that we're going to have to file at the place closest to where my husband is incarcerated seeing they're going to have to have 'his interview' in there.

Even though they're required to do that they don't always want to bother to make the trip out to prisons so I don't know, maybe a lawyer can help with that also?

Ah, I don't know to tell you the truth. The whole thing is driving me crazy! What I was told by USCIS in London was that it must be filed with a USCIS office who has jurisdiction over his prison location.

Too bad that prior thread was taken down. The situation was similar.

OP you are right to think that using an experienced immigration attorney (ideally one that has experience with a USC that is incarcerated for a similar length of time) would be the way to go. The onus is on you to show that you are not marrying for US residency. If you've got correspondence showing the development of your relationship over many years that ought to be a plus.

The petition that your spouse will submit gets sent to a lockbox in Chicago and then is assigned to a service center for processing. The local office comes into play later on.
