Hi everybody

Ok, this is my story. I got RFE, they send me on February 10, but I recieved the letter yesterday stating that I have 40 days to send them my 1040 form. I filed for my tax return beginning of February and I'm still in process. Today when I called IRS, they told me that is gonna take up to 4 weeks to get my return.

Now, the problem is I have 20 days to send 1040 form to immigration and I'm scared that I won't recieved my 1040 by the due date.

I called immigration and they told me that I can't get extention and the lady could't tell me nothing that I allready know.

What do I do now? Is there any other way, please help.

Second problem is when I send them my W2, I had 2 (two) of them. The first W2 was 17,800, second was about 8,000 dollars. For some reason, in the same RFE they are telling me to get a sponsor. I think they made a mistake adding the two W2, because they are telling me that I made only 17,800 dollars.

What do you think about me sending them a letter stating that they made a mistake in adding of my W2 where my income gross is about 25,000 when you add my two W2.

I believe they are talking about the 1040 for 2009, because 2010 isn't due yet. Did you send a complete tax return for 2009 with your packet, including the 1040, or did you just send them W2s?

You taxes are "due" at the end of the tax year which is more or less the end of Jan. when your employer is required to have your W2 to you. It isn't considered late until after Apr 15. Kind of like you house payment, it might be due the first of the month but you don't get a late fee until 10 or so days later.

This will not be over quickly. You will not enjoy this.

Yes, I have send them 2009 but they asked for additional income. Then, I send them my W2 for 2010 because that was the best proof of my income. Now, they are saying the stuff I wrote about my W2.

No, those W2s do not prove your current income. You need to send them a letter from your employer/s detailing your income, job description, how long you've been working there and that you are an employee of good standing. You also need payslips from these employers. You will also need to provide bank records for the past year to prove how much income you were receiving. It's all well and good saying you made so-and-so amount of money, but the bank records will prove once and for all what your income was because it's what was deposited in your bank account.

Perhaps add a typed and signed letter explaining that the 2009 tax return is your most recent tax return. Just say that have currently filed your 2010 taxes, but the IRS has notified you that the forms will not be returns to you until after the RFE is due.
