Hey everyone!

I wanted to start a topic and see who is in the I-601 process and who is already in the US. I would like to compare time lines, approvals, stories etc.

also welcome anyone else who has- or is about to file the I-601 who is out of the USA.

I am currently in the US, and filed back In Dec. so im waiting on word.

hopefully we can get a group together and help each other along this crappy process!

hey everyone,

I had an interview last year in oct 19 and the interview went very well but the consular office said that i need a waiver because i overstayed. so she gave us a sheet in which she marked that

=Section 22 1(g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the Immigration and Nationality Act or regulations issued pursuant thereto. The following remarks apply in your case:*

9B1 overstay, needs approved 1-601 waiver

=Other send in valid Canadian Passport

I hired an attorney and sent my waiver in december to montreal embassy. In january I received a letter from US consulate that I sent a cheque and they only accept money order so I sent money order to embassy (according to my attorney, I have to sent it to montreal embassy)

My husband talked to senator, According to her my case is still in montreal US embassy and she requested Montreal embassy to send my case to vermont ASAP.

still waiting...called USCIS and they told me that US embassy in Montreal is going to work on your case not us.

I recently sent an email to vermont centre to find out my case status. lets see!!!!

So you filed your waiver in the US along with your adjustment of status?

We filed 601 and 212 waivers in July 2008 in Algeria. There was a fairly short round of background checks(3 months) before the file was transferred to Rome where a decision was made. They received the file in Oct 2008 and we were approved in April 2009. It took a month to transfer the approval back and another month for the interview/visa issuance. My husband entered the US July 29, 2009 just over a year after submitting his waivers. It was the happiest day of my life. Our family was separated for 27 long months while waiting for him to return after his detention and subsequent removal in April 2007. My husband is eligible for citizenship in about 13 months...by the time he is naturalized it will be 10 years since our wedding day and 12 years since the first immigration paperwork was filed. It's a long and complicated story that I will share if anyone is interested.

If you look for an OP named Davey on this board he was recently approved at Montreal I believe. I also am pretty sure Montreal sends I601 to USCIS stateside in Vermont for processing. The state department is really quite slow on these cases being transferred to the appropriate office, so stay on it until you can verify they sent it to Vermont.

It seems in this electronic age the DOS could put up a link that lets people pay and generate a receipt # online instead of all this malarky with money orders which you cannot track being sent snail mail... arghhhhhh

Sergi9 is correct - Davey also interviewed through Montreal and had to submit an I-601 waiver. Originally he sent it to the consulate in Montreal but they sent it on to Vermont for actual processing, when it was approved, they sent it back to Montreal and Montreal informed Davey what updated docs they needed and now he's in the US with his wife.

Total turn around for him was a bit over two years (I think).

Good luck with everything!

Hey!

I applied for an I-601 the same time- i got a letter after i was approved my green card in Nov, saying that i need to file a waiver. i had 30 days to apply- which didn't gove me enough time for a lawyer, but i did have a lawyers help online. (pay per question thing) and my husband is pretty good at this kind of stuff.

so im waiting along with you! I applied on Dec 15th- a week before it was due. they said to send it to the address on the letter- which was Atlanta- then i got it on dec 24th, saying that I have to send it to the lock box! #######! but they did date stamp it, to show that it came to that office in time, so another 25.00 for a 2 day delivery and off to the lock box. and they recieved it on the 27th. then i got a notice in the mail and im tracking it. and it hasnt been touched since Jan 14th 2011.

soo...were in the same time line! :bonk:

I went on USCIS website to check and there is no option for I 601 form type. I selected I 212 (Is it the same thing like I601)

https://egov.uscis.gov

Processing Times

1). Select a form type - 212

2). Select a form sub-type - readmission after deportation or removal

3). Select an office - Vermont Service Centre

How to calculate your cycle time

USCIS National Goal - 4.0 Month(s)

USCIS National Average - 14.3 Month(s)

Vermont Service Center - 4.0 Month(s)

finally got the update!!!!

I sent an email to vermont centre and got the reply yesterday in which they just wrote that you have to call 1800 number to check your status. Montreal embassy sent me a reply for my email that they dont have any update info and they will notify me when I will get approve from Vermont.

I called USCIS and long story but at the end I dialed this number 1 877.341.2441. the lady was very nice she gave me this 202 number for visa department. 202-663-1225 to find out the status of my I 601 application.

Finally, I got the update that Montreal sent my waiver to Vermont in the first week of march. (however the lady was so rude :( she told me that I should know abt this becoz i m the applicant.) I told her that I called every where but nobody has any info but she hang up on me :(

the good thing is .... "something is better than nothing" :-)
